Thanks Paul, one can only hope! for a good outcome, don`t think I have ever sent a letter before that has been so specific and to the point (think I usually tend to waffle a bit) so many thanks for having all this brilliant info in the forum to help us.

I`ve just looked to track the letter on Royal Mail site and its not been delivered yet..silly me thought it should have been delivered next day...suppose there is still time.

Not heard anything yet, I have checked on Royal Mail site to track the letter and it keeps saying the item is still being processed throught the network so I have no idea if its been delivered or not (it seems can take upto 5 days before it shows! :b from past experience thought it usually showed the next day)

Did you send the letter first class or second class recorded delivery?

Either way it should have reached them by now.

If the letter hasn't arrived by Tuesday I would probably send them another one.

One can only hope that this one reaches them. :x

Hi Paul,
Received my letter about 6pm last night, would you believe it had been delivered to next door by the postman and as they were out all day couldn`t bring it round until then... its still not showing on the Royal Mail site as being delivered!!

John Lewis have replied that they are sorry to learn of my disappointment with the longevity of this unit and with the quality of service I received when I reported my concerns on the 9th Jan.

The letter has been forwarded to Customer Care for JL Technical Support as they are best placed to investigate and resolve my concerns, and that colleagues at HO will be updated with all correspondence.

They have listened to my telephone conversation with them on the 9th, and they say it does appear to have been a misunderstanding. The Sale of Goods act 1979 (as amended) does not require the product to remain fault free, nor does it require goods to be fit for purpose until the end of their accepted working life, as the act is not the equivalent of a guarantee. The act only holds the retailer responsible for faults inherent at the time of purchase and that, if one develops after 6 months, can be proven by the customer to have been present at the time of sale.

Therefore, if I am able to forward an independent report from an engineer that has physically examined the mahcine and has foud that the laptop was inherently faulty at the time of purchase, then they would of course meet their legal obligations. This would be in the form of a partial refund that takes into aconsideration the amoung of usage I have had of the machine, they would of course reimburse the cost of the report.

They look forward to hearing from me.

I think this seems to be the standard procedure, after reading through a lot of the other postings, do I PM you Paul to sort this out?

I wanted to say thank you to Paul for sorting our laptop, regretably it wasn`t the Nividia defect but blocked fans etc..so its up and working again.

Just wonderting what to do now as John Lewis have been in touch asking where my engineers report is etc. I did`nt realise they would persue it. My original letter was a little harsh (used the template from this site but also mentioned about their staff needing training in Sales of Goods Act etc). Wondering if I should actually reply and say whilst it was thought to be the Nvidia defect its not! just don`t want any bad feeling incase anything should happen in the future (especially as my daughters new laptop is from them), they should be pleased as not having to pay out.

Any suggestions, would be great as I`m feeling a little guilty. Thanks x

I would simply tell John Lewis that you sent the laptop to me for an engineers report but that it transpired that it wasn't the Nvidia defect after all but then thank them for help.

Don't let it worry you too much, if the person you initially spoke to had handled the matter correctly then you wouldn't have had to complain so you have done nothing wrong.
