Hi,

After a few months of waiting around Comet finally offered to exchange my laptop, however I'm still not happy with the exchange. I want my money back. I bought the laptop in 2007 and after supplying them with the engineers report that you provided for me they had no alternative other than to do something about it. The exchange they are offering is not what I wanted, I want my money back.

Am I still entitled to my money back?

What are they offering and what is the value of the laptop they are offering?

How different is the laptop specification wise from the one you had?

Thanks, no I haven't accepted their offer of exchange yet. The laptop I bought back in 2007 was the HP dv2699ea (I paid £829.99) the spec on that was:

Although they have made me their offer, I now don't really know what to do. What I was hoping for ideally was my money back and then to invest that into a desktop that I really wanted rather than being told what I could have.....

I suppose I should count myself lucky that I've even been made an offer at this stage? What do you think I should do? Do you think I would be better off accepting their offer than through small claims etc? Or you think I have good chance of getting some money back to put towards something that "I really want"?

Hello Amit,

To be honest I would advise that you accept their offer as it represents a significant improvement with regard to specification compared to yours.

If you were to refuse this offer and were to proceed to court then the Judge "could" rule that you had acted unreasonably in proceeding to court and "could" disallow your costs.

If you do not want the laptop then you could always sell it on Ebay and you would still get a very good price for it. They you can purchase whatever you like.

Whilst I appreciate the fact that you wanted a cash refund I really do think that this is a very positive resolution.

I'm delighted to say that I accepted Comet's offer of a laptop replacement which I intend to sell and put the proceeds towards another machine. I would like to thank you very much for all your advice and help, without which a positive resolution like this would not have been possible. It's not a bad deal at all considering the defective laptop is now 4 years old.
