Laptop Make: HP
Model: dv9823em
Graphics Card: 7150M GS
Purchased From: High Street Store
Amount Paid: 499
Date Purchased: 21 Nov 2008
Date Failed: 27 Mar 2011
Hi,
First of all I want to thank you, Paul & the team for this forum and the Engineers Report. The time and effort you put into this subject is impressive and was a gold mine for this matter.

Date purchased: 21 Nov 2008
Date failed: end of March 2011
Date first contacted seller: 6 Apr 2011, then on 2 May 2011
Purchased form Currys
So, I had this laptop which was over heating and doing random restarts from beginning, but as it was my first one I just assumed is normal. Then in march 2011 it started to freeze and the screen would be covered with black lines.
It eventually gave in and I started research in the hope I could get it fixed. I replaced the HDD, as a friend suggested, but it didn't solve the problem. A tutor from my college suggested that the motherboard is dead and I should search a replacement on ebay.
I then came across the Nvidiadefect forum which was an eye opener of the scale of this issue affecting computers all over the world.
I emailed Currys customer service on 6th of April 2011, mentioning that I've purchased a laptop from them that proved to be inherently defective, but got no answer.
I booked the laptop with Lapcure, who confirmed that it was inherently defective and provided an Engineers Report on 14th of April 2011.
With this at hand I sent a Letter Before Action with Report on 28th of April to the DSG Head Office and, on 2nd of May 2011, an email to customerservices@dsgiplc.com, with a copy of Letter, Engineers Report and proof of postage.
The Knowhow team contacted me fairly quickly on 4th of May and requested to bring in the laptop so they can confirm the defect.
In the mean time I was away for holidays, and when back, I took it to the Currys store from where it was bought. They recognised within 30 mins that the motherboard and the memory were faulty and told me that I would have to deal further with the guy in charge of my case.
He called me and offered £241 in vouchers, to include the Engineers Report, which I refused.
I pointed him the Statute of Limitations and that the amount that I would be happy with would be £351 (included Engineers report)
On the 14th of July he came back with £273 and said it was final one.
I intend to email them one more time and if not successful, write to the Head Office before filling a small claims form.

I'll be grateful for some advice from you, Paul! ;)
Thank you for reading

Hello Mami,

Thank you for your kind words in your post, much appreciated.

Based on the information in your profile, which is a purchase date of November 2008, a failure date of March 2011 and a purchase price of £499 then I calculate that the minimum refund they should be offering you, excluding the report, is £304.94.

This is based on the Limitations Act, which is six years.

So, including the report, the minimum they should be offering you is £369.94.

Their offer of £273 is therefore well below what you would reasonably expect.

I would inform them of the above and of how they have settled with previous customers based on the Stature Of Limitations.

If they refuse to comply then you should sue them.

Fingers crossed you don't have to go down that road.

I hope the above helps.

Any questions please let me know.

Best wishes

Paul
