Here is my promised update

Success, I am over the moon :! :! :!

Refund under Section 75

My Dell Vostro 1710 laptop purchased from Dell in June 2008, failed January 2011 with screen display problems. I contacted Dell, who said they would repair anything needed and would only charge, I think it was £150, and I would likely lose my data. Horrified at the cost and the thought of data loss I sent my laptop for diagnostic test to private company, who established that the graphics card was faulty. Whilst waiting for them to get back to me, and having the part number I searched the internet for likely cost which was around £350, so I asked for a report, By this time I knew I had a Nvidia graphics card, and soon learned some cards had a defect. After more reading found this forum, thank you Paul, and then realised the extent of the defect, and I had one of the defective cards in my laptop.

I wrote by recorded delivery letter to Dell at Bracknell, was telephoned by Dell India, I then wrote to Dell CEO, again India contacted me. Fortunately for me I couldn't understand the accent, so asked that all correspondence be via email. Got the usual offer of a repair, no guarantees - didn't refuse, left it open ended, was considering my options whether to go to the Small Claims Court.

As laptop was purchased by Credit Card, I decided to try for a refund under Section 75 and wrote by recorded delivery letter to credit card company , enclosing copies of letter, emails and report. unfortunately didn't receive a reply. Royal Mail track and trace showed letter was not delivered. Wrote again to credit card company, reply said we appeared to have a claim, they offered £200. The laptop cost £549 plus £60 for the report. Wrote back declining their offer, 10 days later they telephoned and after some negotiation offered £430, which was accepted.

I reckon that was a good result. :D I may have got more had I gone to Court, but given the credit card offer, it wasn't worth the hassle, and I may have been awarded less.

For others trying to make headway, don't give up, even though the world seems against you, take stock of the avenues open to you, and carry on. Use the links on this forum and read what others have done and said. Introduce yourselves and ask your questions. It is daunting at first, but well worth it.

Hi,

I have DELL Inspiron 1420 with the defective NVIDIA graphic card 8400. I purchased on Aug 26th 2008. It failed on April 21st 2011. When I called Dell customer care, they are telling that they cant replace it. See, issue will come anytime for the defectvie card... Not within one year. it may come in 1 year, 2 years or more. But DELL has suppplied with defective card, atleast they should inform us with mails or phone. They dint do anything and now when I ask, they are not providing the right help.

Please let me know what to do.

Hello Nehemiah and welcome to our forum.

Sorry to hear that your laptop has failed.

Your laptop contains an Nvidia 8400 GPU and is one of the more prolific of the defective GPU's so it is highly likely that your laptop could indeed be inherently defective.

Did you purchase the laptop in the UK and what method of payment did you use?

Hello Nehemiah and welcome to our forum

The good news is that Dell have acknowledged the defect in your laptop and that can be found here:- http://nvidiasettlement.com/pdfs/NVF_NOT.pdf

Unfortunately, I am not sure of the laws in your country so cannot advise as far as that is concerned.

What I would advise however is that you give Dell a call and would tell them that your laptop has failed with what you believe is the Nvidia defect and that you are aware that Dell have acknowledged that your model of laptop is indeed inherently defective.

They may tell you that you are out of warranty so you should tell them that as they have acknowledged the defect in your model of laptop then the warranty is irrelevant.

Give the above a try and see that they say.

I am sorry that I cannot advise you with regard to the legal options available to you.

1. See my issue is, sometimes display is coming. after that, it goes. when i switch off my laptop for 1 day, after that it will work for sometime (I should not run any softwares or movies that takes much graphic card memory.). After this problem came, I Uninstall NVIDIA driver, so without graphic card driver, I am running my system. When my system is switched on and if it overheats, display goes. This is my problem.

2. See when display is not working, I used to connect my machine to external monitor. It works for sometimes but later it also goes.

Explain whether this is the issue with Defective Graphic card or not.

Need one quick Information:

What are all the affected models of NVIDIA 8400 ? Is that only NVIDIA 8400M GS 256 MB? Not 128MB?

When I asked Dell, they are saying that only 256MB cards are affected. Not 128MB. Mine is 128 MB card. Is that true?

Please reply me...

Hello Nehemiah,

Take absolutely no notice of Dell when they say that.

The amount of memory is irrelevant as it is the GPU that is defective and these were installed into all types of laptops.

The problems you describe certainly sound like manifestations of the defect so I would say that it is highly likely that your laptop is indeed inherently defective.

I would get back onto Dell and would tell them that you do not accept their response and that unless they comply then you will pursue this further.

I called Customer Care. They said no. I told him to call his supervisor. He also said no and said that defect was only on 256MB. I told him to call his executives. Now they will call me. I am waiting to blast them.
