You should make a note of all the times you have called them, the time you have spent researching this, all your ancillary costs and add them on to your claim.

You must have done a fair few hours research and that can be charged at around £7 per hour.

I would also send Comet an email telling them the full costs of what your claim will be and that you will be filing online that day unless they come back to you with an offer within, say, a couple of hours.

That should move things along nicely.

This sounds like a good idea, do you have an email for Comet Head Office? What would you say in the email?
Do you really think the company should compensate you for the time you dedicate to research?

There is a template letter that you can download from our forum.

That is available here.

Have you already sent the retailer an engineers report?

You should make a note of all your costs in case it goes legal.

As I said previously, you can also claim for the cost of researching his matter at roughly £7 per hour.

RESULT!!!!!

Just got off the phone with Head Office, they said if I take my laptop back to the store I can get a replacement!

I have to dig out my receipt and anything I still have that came with it, manual etc, which I do still have knocking around somewhere, then they will give me a new laptop!

I have to get my friend to take everything off this one first, I have LOTS of photos etc that obviously want to get off, so will *hopefully* be updating with a success story very soon!


p.s If I buy a removable hard drive or something will that take all my photos? I want to get this swapped asap!

Yes, get yourself a removeable drive or even a USB stick and you will be able to back up all your photo's etc.

My laptop is HP dv9292 it failed for the first time in October 2008 and Hp replaced the motherboard. The second time it failed was in November 2009. I've just sent a letter to comet where it was purchased asking them for a full refund or taking them to the small claims court. I've also been in touch with HP and today they sent me an email offering me free repair. What is your opinion on this matter? Should I accept the free repair and what is the chance that the laptop will not fail again? Or should I battle with comet? Thank you for your opinion

Hello Vlastimil and welcome to our forum.

I would not recommend a repair to our laptop.

Unless and until the retailers can provide a written guarantee that the board will be 100% free from the Nvidia defect then I would say stay well away from a repair.

Your sales contract is with Comet and so it is them who you should pursue.

After having 2 failed motherboards you are well within your rights to demand a refund or a replacement laptop.

They could try to force you into a repair.

I would reject that on the grounds that 2 motherboards have already failed and that you need a reliable laptop.

If they fail to comply then you should secure an engineers report to prove the laptop is inherently defective.

Once you have that you should give them one final opportunity to resolve the situation.

If they still fail to comply then you should sue them through the small claims court.

They will soon pay up then.

If you need any help or advice then please let me know.

Please also keep us updated on how you get on.

this is the reply to my email before action I have just received from comet :

I was very concerned to learn of the problems that you have experienced with your product. Please let me say how sorry I am and thank you for taking the time to get in touch.

If a fault develops with your product, it is protected by a 12-month guarantee from the date of purchase, which covers the full cost of spare parts and labour. The length of the guarantee is usually sufficient for any technical problems with the product to materialise.

Comet will not charge you for repairs carried out under the guarantee period. However, if the manufacturers’ guarantee or extended warranty on your product has expired, repairs are chargeable.

To move forward in resolving this matter, I would ask you to please contact our Comet on Call service department on telephone number 08448 920 999.

Please accept my apologies for any inconvenience this may cause you and I am confident a member of our service team will be only too pleased to assist you.

Judging by my case, I would recommend sending a recorded delivery letter, and mention that you will be taking it further via Trading Standards if necessary.

Give them 7 days to respond, KEEP YOUR RECORDED DELIVERY RECEIPT cos Trading Standards will ask for it should you need to go down that route.
