Hello Jo,

Well, looks like you are one step closer to a satisfactory resolution.

The "reverse burden of proof" bit is standard and is something that all retailers can call upon.

Proving the inherent defectiveness of your laptop is easy by way of an engineers report.

Regarding the repair of your laptop we do not, at this stage, recommend customers accept this as there is no definitive proof that the parts being used will not fail again with the same problem.

If a retailer or supplier were to give such a written guarantee then a repair would be acceptable.

The cost of the report is £65 which includes the collect and return carriage.

Just so you know you can recover the cost of this from the retailer.

In order to proceed please do the following:-

1) Please go to http://www.lapcure.co.uk/register.php

Complete the registration page and then verify your email address.

2) Once you have done that please then login to the site and click on the
"Add a job" link.

Fill in details about your laptop and then once you are sure the details are
correct please save the record.

Once you have done that the courier will be booked to collect the laptop the
next business day.

We use DHL for the collect and return carriage.

Please ensure that laptop is securely boxed with sufficient packaging to
withstand transit to ourselves.

Once you have booked your laptop in I will email you with the label to place
on the box.

Turnaround time is usually five days and payment is not due until the report
is ready.

I will email you a PDF copy of the report and will include 3 copies of the
report and invoice with your laptop.

Have been spreading the word. Internet pal of mine has been having awful pc problems an d I asked her outright if it as an NVidia fault and it is. Apparently HP had extended the warrenty on hers and other laptops. Laptop has been back to Comet 5 times so far and latest "fix" has failed within a month. Funnily enough, she wants her money back now.
She was aware of the HPLies forum but not this one so I've directed her here.

The more people aware of the problem, the better and then perhaps we'll get some more positive action from HP.

Staples have caved. Replacement offered or refund on proof of purchase to be negotiated.

Letter states they do not recommend a repair due to the lack of reliable parts.

Paul, I didn't include your explanation of the report i.e. how it is not a pro forma as I was fully prepared the argue with them if they chose to reject/question a report that fully provided and fulfilled all the requirements that they requested.

Pat on the back for you though, Paul as they say they "commend the author of such a full and detailed report".

I now have to provide a proof of purchase in the way of a bank statement as (typically) I cannot locate the receipt. I may have a look at consumer law as I know there is something there about not being requred to provide a receipt if an item is faulty, but given the length of time of ownership, this may not apply.

I'll keep you updated regarding my quest for a refund, but wonder if anyone else has secured a refund without a receipt?

Wish I could get one from every retailer - or is that just me dreaming. :roll:
