Hi :nh

I bought my laptop in JAN 08 and i had problems with my laptop in DEC 08 and it went in for repair in JAN 09. It then had the same problem in SEPT 09. I then contacted PC WORLD and i was told that as it's out of warranty they didn't want to know.I had contacted Trading Standards about this and as i couldn't prove the fault there was nothing that they could do.So my laptop has been lying here not used.I have just found out about this site and it looks as though my laptop has this Nvidia chip as it is displaying the 6 screens and then the BSOD.I have contacted PC WORLD today and i explained to them about this and i was told that someone would call me back to let me know what thet are going to do.What i am asking is IF they offer me a refund what should i expect to get , i paid £599.99 and i only had the laptop working for about 19 months.I did contact PC WORLD in SEPT 09 so should i ask for to get a refund from then or now.

Hello Lorraine and welcome to our forum.

Sorry to hear that your laptop has failed.

The amount that you would be entitled to by way of a refund depends on whether you can prove that you notified PC World of the fault in September 09.

If you cannot prove this then PC World will probably take the date as failure as being June 2011.

If June 2011 is to be the accepted date of failure then you would expect to receive a minimum refund of £258.33.

What were the original problems that you were suffering? Do you have any evidence that your laptop was repaired previously?

Hi Paul

Thanks for you reply. I had the repair done by PC WORLD and it should be on their records about myself and Trading Standrads contacting them in SEPT 2009 about the fault. I tried to contact Trading Standards today but no one was in so i will contact them on Monday as i still have the reference number that they gave me. The fault with the laptop is that it is displaying 6 small screens and then it shuts down showing the BSOD also it was overheating. When it was repaired the worksheet had stated that they had replaced the hard drive, also when it was in for repair they sent it back out without doing a repair and it had to be sent back and when it was returned the casing was cracked and it had to be returned back again , it still was overheating but as it was working i didn't bother with that. I still have all the worksheets that they sent and the case number that they gave me.

Hello Lorraine,

Excellent news that you have all that information, you must be a really organised lady so all credit to you. :D

I think that we can safely say that the date of failure is February 2009.

This means that the minimum refund you would be entitled to is £491.66.

As a matter of interest, how did you pay for the laptop? If you paid by credit card then you have extra protection.

Please let me know how you get on with Trading Standards on Monday as that will be interesting.

Thanks for your last reply. Just wanted to let you know if i have just been offered £340 for my laptop , but as i had notced from your last reply you said that i should get a minimum of £491.66. Is this correct or should i accept the £340. If they don't up their offer can i refuse this and ask for more ? or do i have to accept this offer? I was already offered £240 earlier and refused this as they had quoted me on having the use of the laptop for 40 months but i had explained that the laptop was not working from Jan 2009 and they repaired it as it was still under warranty and then it went down again in Sept 2009 and that i had contacted them again about this.

Hello Lorraine,

Their offer is way too low if we are working on a failure date of 2009.

It does appear that they have calculated the refund on the basis of 40 months usage and not the 19 months that you state you have had.

As long as you can prove that you told them in September 2009 that your laptop had failed and that they refused to do anything then you should pursue this further.

You do not have to accept their offer if it is not fair and in line with what you are legally entitled to so don't worry about refusing it.

I would also advise that you contact Consumer Direct and ask their advice. As I said, if you can prove that you reported the failure in 2009 and if they refused to do anything about it then, in my opinion, the reported date of the failure is 2009 and not 2011 as they are claiming.

Hi Paul,

Just been made an offer from pc world of £340 again and i refused, then they offered £360 and i asked about the fee for the report that i sent ,they then took the extra £20 off the offer. So all they are offering is £340. Contacted Consumer Direct about this and they have said that its up to me as they can't advise me on what to accept, but that i could still refuse and go to court with them and see if i could get any more but that there is no guarantee of that. So do you think that this is a reasonable offer?

Why on earth did they offer £360 and then deduct £20 because you asked for a refund of the report fee?

What kind of business practices is that?

I have a question in order to be able to answer whether their offer is fair or not.

Since reporting the six split screen problem to PC Word in September 2009 did you at any time after that use the laptop again?

Whilst you have a reference number for the September 2009 problem, have you any documentary evidence that you could show to a court that would prove that you did indeed report the fault in September 2009?

This is quite important because it makes the difference between the amount of time PC World claim you have had use of the laptop and the actual use you have had.

Please let me know and I will advise further.

Thanks for your reply, I have got copies of the e-mails that i sent and the ones that i received back from them in SEPT 2009,and they also verified to me that they have this on their files. So that is the only proof that i have got . I have not been able to use the laptop since SEPT 2009 . Also Trading Standards still have the details of me contacting them and also that they contacted pc world about the problem. I hope this will be enough proof for me to take this further.I have to tell them tomorrow what my answer will be.

In that case then I would say you can prove failure occurred in September 2009 and that you were fobbed off at that point.

Therefore the refund offer that they have made should reflect this and not the 40 months that they are claiming.

I would give them one last chance to make you a reasonable offer in line with the actual usage that you have had.

If they refuse to comply then you should waste no more time on them and should proceed straight to www.moneyclaim.gov.uk and you should file your claim.

You have a very good case and I would be surprised if PC World allowed this to proceed as far as court.
