hello again paul

as i said in my earlier posts i sent this report over 12 months ago!
that is when they replied with the 70% offer and asking for their report.

should i now get another more comprehensive report?
where from and how much will it cost?

i am a full time carer for my daughter who has cerebral palsy and cannot afford to keep getting reports?

your help is very much appreciated

COMET have already seen this report and said i had to pay for theirs over 12 months ago

do i need to get a more comprehensive report if so where from??

i can ill afford to keep paying for reports as i am a full time carer for my daughter who has cerebral palsy.

do you think i will get anywhere or should i give up? :c

Hello Adrian,

Sorry to hear that Comet did not accept your original report. This could be due to the lack of comprehensive testing.

I would say that you do need an additional engineers report in order to prove your claim.

Because of the situation you are in I am prepared to help you insofar as I will provide you with a report and allow you to pay for it once you have been refunded by Comet.

If, upon inspecting your laptop it is found that the fault is not related to the Nvidia GPU then all you would pay is the cost of the collect and return carriage, which is £20.

I can appreciate that things must be difficult for you due to your circumstances so I hope I are not offended by my offer.

Please let me know if this is to your approval.

The cost of the report, which includes the collect and return carriage, is £65. This amount is refundable from the retailer as a consequential loss.

hello paul,
comet have now inspected the laptop and this is their reply :

"It is with regret that I inform you that Comet are unable to offer you a refund on the appliance as you are requesting. This is because after our Service Department have inspected your laptop and are offering to install an upgraded FLET board which they are confident will resolve the issues you have experienced with the unit. They are also able to repair the faulty keyboard at a charge of £19.00 and the PSU at a charge of £21.76 should you require.

We are unwilling to cover the costs you incurred with regards to obtaining a 3rd party inspection as we have offered previously to inspect your appliance."

obviously i am not happy and have told them so on the telephone but they said this is their final offer.

any idea what to do next please?

How on earth are you supposed to know what an "upgraded FLET" board is?

If this is a mainboard are they offering any form of a guarantee that this upgraded board will be free from the Nvidia defect?

If not then you should ask for it.

On page one of your thread you stated:-

So they did tell you to get an engineers report. How can they now refuse to refund it?

If you had provided Comet with an engineers report that stated your laptop was faulty due to the Nvidia GPU then under no circumstances should they have tried to charge you to inspect it. They should have inspected the laptop at no cost to you in order to verify or refute the findings in the report.

Did they say why the first report that you sent them was not good enough? It is, in my opinion, not good enough that they rejected the first report that you obtained out of hand.

So, you have provided a report that states your laptop is inherently defective and not only do they try to charge you to inspect the laptop but they also want you to pay 30% towards the repair. I am sure that the Judge, if this gets that far, would love to hear about that.

Did you pay Comet the £50 for the inspection? If so, what did they conclude?

I think that there is enough evidence to support the fact that they asked you to provide an engineers report.

hi paul and thanks for the quick response
apparently this flet board is a new motherboard and the guy i spoke to said his engineers were confident that this would fix the laptop.he did not say whether they would guarantee it would be free from the nvid defect.
i do not want them to fix it anyway- we already bought a new one and if they fixed it and i tried to sell it i doubt i would get the cost of the two reports back on it let alone the purchase price as it is now 4 yrs old (been broken for 2 1/2 years of that lol angrily) :@
have you any idea on the legal aspect of this now as they have offered to repair it (albeit 2 1/2 years late!!!)
i am at a loss where to take this now - the big companies always seem to get away with it comet are useless
and half of their customer services dont seem to know what they are doing and dont care about their customers. :c my advice DONT BUY ANYTHING FROM COMET!!!!!

PS they never gave a reason for not going by the first report and i refused to pay for their engineer to tell me what i already knew because i couldnt afford it

Hello Grandadoakley,

You should insist that they provide a written guarantee stating that the replacement mainboard will be free from the defect. You should also ask them for the part number of the board that will be used so that we can check the details of it.

Without a written guarantee you should insist on a refund. If they refuse then you should file a small claims action against them.

This has been going on for far too long now and the Judge will see that you case has been handled wholly unreasonably.

Please don't be downhearted. Keep the fire burning in your belly and stand up for your rights. It took a long time to pay for that laptop and you should not just let them defeat you on this.

Persistence really is the key to success and as your laptop is inherently defective then you really cannot lose.

I would give Comet a call and would give them one final opportunity to settle with you. Tell them that you are aware of this forum and of all the successful court cases against them so you are more than confident if this were to proceed to court.

If they capitulate then great. If not then you should sue them.

Don't worry about that, it is not as daunting as it may appear and we will help you all the way.

Finger crossed it doesn't come to that.
