Hi,
Just sent the letter "letter before action". Phoned Comet branch where I bought my HP Pavilion6700 laptop and they tried to charge me for repair because it was out of warrianty and it was the manufactures fault not theirs. They also said we should have reported the fault when we bought the laptop why buy if we knew about the fault

Hello Bromby and welcome to our forum.

You should completely ignore that bit of information.

If your laptop is inherently defective then the warranty status is irrelevant as you have six years to take action against a retailer when the goods in question are inherently defective.

It may well be the manufacturers fault that the laptop is inherently defective, but as they sold you the laptop then it is 100% their responsibility to resolve the situation.

They cannot tell you to go to HP as you didn't buy from HP, you bought from Comet so only Comet can resolve the matter.

What a load of baloney!

What on earth are they going on about saying something like that?

How were you to know at the time of purchase that the laptop was inherently defective?

Would you really have purchased it if you knew?

I think not!

Comet really should start training their staff better as the information that comes out of the mouths of their customer service staff is absolutely abysmal.

Don't let them fob you off with this. Stand your ground, be persistent and you will succeed.

If you have any questions or if you need any advice then please let me know.

Good luck and best wishes

Paul

:! I am now the owner of a new laptop (Acer Aspire 5741G). I have followed the step by step guide and used the template letters. It got as far as a Engineer Report which I sent last week and I got a reply very quickly offering a brand new one .
When I exchange the laptop they said it was a common problem , thats a change from my first conversation I had.
Many thanks to this forum because I was all for buying a new one. Cheers :! :! :! :!

Hello Bromby,

Well done on your success :! :! :! :!

I am really pleased that you managed to reach a positive resolution without the need to go to court.

When Comet saw that you had obtained an engineers report they probably realised that you were serious about taking action hence the change in stance.

Well done again though and I hope that you get at least five years use out of your new laptop.

Best wishes
