I have just been doing some calculations and think that their offer is way too low.
I would propose a settlement based on the following calculations.
You stated that the finance agreement is for 48 months at £30 per month. I calculate that equates to a total payable of £1440. (this figure will need to be adjusted if it is lower or higher than £1440.)
The finance company have quoted a settlement figure of £388.42.
£1440 less the £388.42 = £1051.58.
If we were to work on the principle that a laptop should last five years then the calculation would be as follows:-
1) A laptop should last 5 years = 60 months 2) The amount in question is £1051.58 3) £1051.58 / 60 = £17.53 (This is the monthly rate) 4) You had 33 months usage 5) 60 - 33 = 27 (This is the unused usage) 6) £17.53 * 27 = £473.21
So, based on a five year life expectancy the minimum they should be offering you, excluding any other costs you may have incurred, is £473.21.
If we were to say that due to the value of the laptop then one would expect it to last as long as the Statute Of Limitations, which is six years.
Under those circumstances the minimum that they should be offering is £569.60.
I take issue with the fact that your are expected to pay off the outstanding balance on the finance agreement when you do not have the laptop and so the balance that is due on the agreement, £388.42, should be written off.
I would therefore go back to them with the above proposals and would tell them that you have no intention of paying another penny for an inherently defective laptop. Consumer Direct were quite correct when they stated that both PC World and HFC Finance are jointly and severally liable and so if you were to sue then you should sue PC World naming HFC Finance as the 2nd defendants.
