Hello and thanks for your post.

Your story is one I hear on a daily basis and I have to sympathise with you.

However, you are in a very strong position.

Firstly I would forget about HP.

Your contract is with Comet and it is they who are responsible.

We have been successful on numerous occasions at getting a positive resolution
out of Comet.

There are a number of threads in this forum of people who have been successful
after Comet had initially rebuked them.

There is a "letter before action" available for download under the
"Law and sale of goods act"

You should download this letter, fill in your details and send it to Comets Head Office.

Depending on their response you will probably need to get an engineers report to prove
that the laptop was inherently faulty.

This is very important as it means the laptop breached the SOGA at the time of purchase.

Armed with the engineers report and the wealth of supporting information that is available
I would then advise you issue a small claims against Comet.

Believe me, each and every time we have done this not one single retailer has gone to court.

Instead, they choose to settle at the 11th hour.

This is your best course of action and the only one which will ensure that either:-

a) you get your money back
b) you get a sparkling new laptop

At first, this may seem daunting for you but don't be bullied by them. They will say no
all the way until they get the court papers.

They soon change their attitude when they get the engineers report proving the fact that
the laptop is inherently defective.

As I said, be prepared for them to say no all the way - that is their tactics.

But if you persist and show them that you are not going to go away, then you will get a positive resolution.

If you look at hplies.com and look for the thread "good news another uk customer gets 100% refund" you will see on page 13 about a poster called Hannabtw who has just secured a replacement laptop from Comet.

They said no to her too.

Just caught up with this thread!
Firstly, Welcome to the forum, imoneofthem :D
You have definately come to the right place for advice!

I've practically finished my dealings with Comet, now, after a couple of months worth of hassle over a refund/exchange.
I'm just waiting for them to send me a letter that I am to take into store with my now-dead HP Pavilion DV6285 to exchange for a nice brand new (NON-HP!!) laptop.

You must follow exactly the steps that Paul (Lapcure) sets out, and I will guarantee you will have success with getting the retailer to cough up an exchange (Comet dont "do" refunds :roll: )
You will most likely have to take it all the way to Court stage...i.e, actually filing in the County Court, before they sit up and take notice.
You need to address your initial SoGA letter and all subsequent letters to Nick Hanson in Customer Care Department, he was very good actually...once you get through all the waffle.
If you need a good contact number for the CCD at Comet, to cut through having to do the automated stuff on their regular number, then please PM me and I will let you have that, it is invaluable in the later stages of your claim, and is a normal landline number, so probably cheaper than their other one!

Good luck though! You need to be prepared to bat letters back and forth for a couple of months, but eventually you will get somewhere with them! Comet are one of the worse offenders in dragging stuff out...why they cant make it simple for us, I don't know..but hey-ho, if you get a positive result in the end, cant grumble really :)
And dont forget, when they authorise your exchange...dont, what ever you do...get another HP..lmao!

Wow thank you for your support hannahbtw and Lapcure I really do appreciate this.

Hopefully Comet will either replace or quite possibly refund the machine since I cannot trust the probability of it breaking down during my time at university after a repair.

Wednesday 26th August 2009
Today I called the Tottenham Hale branch and spoke to someone from the sales department. I discussed with them about my HP laptop, when it was purchased, etc and her answer was an expected one "You're out of warranty and need to pay for a repair, I could give you the manufacturers contact number if you wish". She said that if I were to come to the store in person I'd be able to discuss matters further with the manager although I believe nothing would've gone further whether or not that were to happen.

I didn't ask for the woman's name...that may be the only mistake I made, otherwise I was an assertive and fairly polite person over the phone.

Thursday 27th August 2009
Tomorrow I will be sending the letter (using the template Lapcure created) via recorded delivery to the Head Office. As mentioned in the 'What steps should I take now?' thread if they fail to correspond within the 14 days of the letter being dispatched I will seek an engineer's report and further myself with legal actions.

Good luck with your case. I'm currently in the same position with PC World. However, I was told yesterday by cutomer services that every laptop that they sold with the defective GPU should have been recalled since its unsafe. Actually directed the chap to this site and hplies.com.

In the event that I can get it in writing from PC World about their claim that they are unsafe, I shall pass it on to you. This will undoubtedly help you on your way.

It's been approximately 1 week since I sent the letter to the Head Office of Comet regarding my faulty DV9288 laptop and they have not replied. If nothing is received by the beginning of next week then I will seek an engineer's report as well as preparing for legal action.

Spoke to someone today from Comet HQ and gave him the story of my laptop containing a faulty video chip, feeling the effects not having a laptop/computer at university and demanding a replacement or refund of the laptop. Here's where it became interesting:
- Supposedly if the laptop is out of warranty you are required to hand it in to a Comet store, pay £49 so they can send it to an external engineers for an 'official' report, BLOODY CHEEK after having been to a verified laptop repair shop in South London for a report and also can obtain one from the university laptop repair store.
- If the video chip is to be confirmed as faulty from manufacturing point then they will offer a free repair plus a refund on the engineer's report. Of course I countered this by explaining the video chip can only have a temporary fix which I cannot accept since I'll be constantly be using the work for independent study at university.
- He brought up the Sales of Goods act and 'filing a small claim' after stating the point I made above.

Believe it or not Paul I believe your reports have become infamous with Comet and the staff are weary of them! :D
Before speaking to the above mentioned person I had a semi-conversation with a woman from their customer service over the phone (the connection was bad and eventually cut off hence the semi-conversation) and when the subject arrived to the engineer's report she explicitly asked "where did you it from?". I'm sure she was expecting a certain reply to that one hehe.

Paul I believe your engineer's report will be required for this pursuit of mine but first I wish to call them again and make them reveal why I cannot use an independent engineer's report despite the laptop being out of warranty. What am I meant to ask and what am I going to expect them to say?
