Hi all, I have started a new topic so that users can see my story which i plan to update everytime i get more news on my 'journey'.

1- It all started when HP DV6500 failed on me when I was using it on Monday. After some research, all from here, I knew that it was an Nvidia Graphics Card problem.

2- Today, Friday, I went to Comet in search for a refund, although knowing full well that this would never happen at this stage. From the advice I got from here (thanks all!) I put up a polite 'fight' saying that it's inherently defective, that i shouldn't go to manufacturer as i have a contract with them not HP and to go away with an address to send letters to. They told me that as i brought it in January '08 they can't refund me.

3- My next step: I have got the address now to which i plan to send my "Letter before action" so if after seven days from posting i hear nothing I will then send the engineers report.

I assume I am doing everything right so far! Let me know if i'm not! One issue I have is that it was my father who brought it for me, so technically, should he be doing this or could i do this? Also, can I have the opportunity to just get the refund as opposed to getting a replacement? I don't really want another HP!

I'll let everyone know what happens when I get to the next step and plan to do this for the whole of the 'saga'.

Hello David,

If you could let me know the exact model of your laptop I will see if I can find any more information relating to your laptop.

This information is on the white barcode label on the underside of the laptop. If you could also let me know the P/N then that would be great.

If this is the case then it should be your father who starts the ball rolling but he can then request that all further communications be conducted through yourself. The engineers report will also have to be in your fathers name.

Yes, you can state that you want a refund as compared to a replacement as you have already secured a replacement due to the urgency of the situation.

You may not get a full refund and it could be reduced according to usage so you have to consider is a refund best or a laptop, which you may be able to sell for more than the refund amount.

You may be in for a bit of a battle but if you are persistent then you will reach a positive resolution.

Next to service tag it says DV6623em, if that is of any relevance.

Will get dad to send off letter. Should it come to a small claims court, could i represent him?

Hello David,

Well, I have checked your model and HP didn't release a BIOS update for it. That doesn't mean that your laptop isn't inherently defective, just that HP didn't release an update to switch the fans on continuously.

If it were to come to the small claims court then you can indeed act on behalf of your dad, though I don't think that it will go as far as court.

Well I finally got a letter back saying that with my Serial and Product number my laptop doesn't have any problems and that it was clearly fine when they sold it to me. They have basically attempted to close the case saying that if i want to take it any further the ONLY option is that i pay them £49.99 for it to be checked... Now, i've been on this site enough not to take this option... right?

I'm up to step 3 in the step-by-step process in which i need to get an engineers report.

I may be wrong and they may be right but we'll see after the engineers report.

Hello David,

Don't worry, the response that you received from Comet is pretty standard so there is nothing new there.

You are quite right to refuse to pay them the £49.99 for their "inspection" which would, no doubt, conclude that the mainboard had failed rather than the laptop was inherently defective.

Don't worry David, if you book the laptop in and it is not the defect then all you would pay is the collect and return carriage.

If the fault is caused by something else then I will quote you accordingly. If you decide not to proceed then you still only pay the cost of the collect and return carriage, which is £20.
