Hi everyone,

Just a little update on my situation if anyone is interested.

I am suffering from the NVIDIA defect in my Sony VAIO AR41 laptop purchased from Comet. I secured a report (which is excellent) from Paul that confirms this.

Following Pauls brilliant advice I have sent the letter before action with a copy of the report to Comet who have replied "offering a 10% discount off the cost of the repair" as a gesture of goodwill :evil:. Obviously this is not acceptable.

After calling them to discuss this, I was told this is the final offer (I thought they were quite rude about it too, almost like "why don't you just go away and stop annoying us").

The next step is a Small Claims summons.

Here I have a couple of options that I am considering.

1 - Do it myself - a bit daunting, but I am prepared to do this
2 - Home Legal Protection - I've used this before to sue a retailer. Pay £50, get a solicitor to do everything for you! When you win they claim their fees from the retailer as well as the excess.

Before I decide which way to go, there are several small issues I need to check out, but I have also been in contact with Trading Standards via Consumer Direct. I must say that these guys are good. They have checked over all my correspondance with Comet and have recommended that I proceed with a Small Claims action. I think that this is another thing which will look better in my favour when I appear in front of the judge.

Whilst in discussion with Trading Standards, we got around to talking about how Comet appear to disregard their rights in law unless you are willing to go to court to force them. My query with Consumer Direct was passed to my local Trading Standards department who have noted my complaint. I asked if there was any way for Comet to be investigated by Trading Standards about their practices, so he has agreed to pass my complaint onto Hull Trading Standards.

Can I therefore suggest Paul, anyone who has an issue with Comet, please contact Hull Trading Standards directly to communicate your issue to them. The more people who do this, the more likely that trading standards will HAVE to take direct action against them.

This obviously applies to other retailers, pass your issue directly to the trading standards office that is local to the retailers registered head office.

Will let you know what happens next...

This just shows you how thoroughly unprofessional and ignorant of the law Comet really are.

They have absolutely no idea do they?

Time and time again they have been whooped into defeat over this matter yet still they blindly try to defend what is the indefensible.

Disgraceful behavior and how dare they try and charge you to repair what they know to be an inherently defective laptop. You should also inform the judge of this when you get to court.

I agree with you regarding reporting them to the Trading Standards, like you quite rightly said, the more people that report Comet the better.

You will reach a positive resolution in the end, it is just unfortunate that you are up against Comet.

hi paul,

i was absolutely raging when i last contacted comet. the disregard they have for their customers is unbelievable.

i have found that a good way to relieve the tension, is to pop off down to the post office and mail off approximately half a kilo of claim and supporting evidence!

comet, bring it on.

I had to laugh when I read that, though to be honest they probably won't read it as they will have no intention of going to court.

I would say that you will have an offer any time soon as they simply cannot defend what is the indefensible.

yep,

might be a good idea for comet to settle all the claims against them just to be sure :twisted:
