My HP lap top DV2535ea died a few weeks ago due I think to the Nvidia defect and I have been negotiating with John Lewis where I bought it in Oct 2007 for £699. Again I came up with the usual it is out of warranty, HP will charge to even look at it, etc. I have spoken with someone at John Lewis today and had to be quite firm, and eventually they have offered me a £400 allowance towards either a repair or a new lap top. They also suggested they would not recommend the repair as they don't know what else might be wrong with it. It is not a perfect solution but is it a good solution? ie should I go for it?

Using the basis that a laptop should last say 5 years.

You have had 31 months worth of use out of it - so current value would be 699 x ((5 x 12) - 31) / (5 x 12) = 337.85,

So if you have not had any other reports done, an engineers report which would increase the cost, I would take the 400 quid - but that just my point of view.

Others on this website may be able to offer better advice, but I'm guessing a Judge would see £400 as a fair offer for a 2.5 year old laptop.

Hello all I am new to the forum but was encouraged by Julie's story. I also have a DV2535EA bought from John Lewis at The Mall Bristol in August 2007, this has also gone the way of so many others and I now look at a black lit screen.
Having contacted John Lewis they are aware of the 'HP list' and that my model is not on it, stating that I can bring it in and they will have it examined to see what can be done, not necessarily at their expense.
They also said that they were unaware of any resolutions being made to any customer with a laptop not on the list. I would therefore be grateful for any further details from Julie as to the store she dealt with and the way she persued them to get her result. I would be happy with this outcome rather than the drawn out process of the SCC.

Hi Goose,

I have just received an expedient response from John Lewis by sending a no nonsense letter direct to head office.
I have the same laptop as you, with around the same purchase & fail date. I bought from John Lewis online, who were unhelpful on first contact but when I wrote direct to head office with the facts, copy of relevent evidence (you can find everything you need on this site) and asking for a quick resolve, they rang within 3 days of me posting said letter. They offered for me to choose a new laptop for up to the same original purchase value from their website (I had asked for either a guaranteed repair or replacement laptop of similar spec - wasn't interested in a part refund as I still need a decent laptop). I am waiting to receive a sony vaio next week, when they are also taking away the 2535ea.
In the end they didn't even ask for a full engineers report, although I offered to get one & would have been booking it in with Lapcure if they had.
The address I posted my letter to (recorded delivery) was:

Just to let you all know that I picked up my new Sony Vaio from John Lewis today with a £400 allowance against it. They have never even looked at my old one, just taken what I said on trust.
I have to say I was very firm with them originally and did say that it was their job to sort out my problem, as my contract was with them. I have to also say that I am an ex-John Lewis manager, so it probably helped to get a speedy resolution! I dealt with JL Newcastle. Good luck to all of you.

Well, they would say that wouldn't they. Maybe they don't know you are a member here?

They have certainly offered resolutions to customers with laptops not on HP's wholly inadequate "list" they just don't tell everyone that as I guess that they will have to foot the bill for your laptop.

You see, if your laptop was on HP's "list" then John Lewis will be recompensed from HP. If not, then John Lewis pay out from their own pocket, which I guess that they are not too happy doing.

But, they have an obligation under the Sale Of Goods Act and it is totally irrelevant that your laptop is not on HP's "list". If your laptop is indeed inherently defective then all you need is a report stating this fact and then you really cannot lose.

John Lewis's attitude will change towards you one you have that report as you can then threaten them with legal action and they will be forced into either offering you a resolution or dreaming up a defence to their indefensible position.

Remember, a repair is out of the question as there are no reliable parts available.

If John Lewis try to force a repair on you, then you should ask for a written guarantee, on their company headed paper that states the following:-

"The motherboard being used to repair your laptop is from a completely new batch and is 100% free from the Nvidia defect. If, at any time in the future, the mainboard proves to be inherently defective due to the Nvidia GPU, then a refund or replacement laptop will be offered"

If they are unable or unwilling to offer this guarantee then I would reject their offer of a repair on the basis that if they do not have the confidence to offer a guarantee then you do not have the confidence to accept their offer of repair.

If they went to court they would have to explain to the court why they couldn't offer a written guarantee.
