Hi

I purchased 2 HP DV9500 (Nvidia 8400) laptops in November 2007 from PC World Business. In 2008, after complaining that the laptops were overheating, they picked it up for repairs but sent it back stating no fault could be found. Nevretheless since then I continued using 1 laptop a lot more then the other so that I don't damage both the laptops at the same time.

Last year around October 2010, the 1 laptop screen starting displaying flashing colours and sometimes went black. I thought this was the end of it and I could not afford the cost of repairs/replacement. I finally found this website recently and realised that I could claim compensation or replacement.

I called PC Word and PC World Business numerous times but they have not yet dealth with the issue, they got HP to call me but HP stated that the laptop is not within the database of Inherent NVidia Defect and that I should contact PC World for any claims. I contacted PC World Business once more today and they say they'll look into it and provide me a response within 2 weeks.

I paid for both these Laptops with a credit card, can I still contact the credit card company for a refund? Over 3 years have elapsed since I purchased the laptop so I'm not so sure about the protection I would receive from the credit card company.

Hello Maaz and welcome to our forum.

Sorry to hear that one of your laptops has failed.

You have said that you purchased from PC World Business. Were these purchased in the course of your business or did you purchase them as a private individual?

What does it state on your invoice? Is it your personal details or is there a business name and address?

You have also stated that you paid by credit card. Was this a personal or business card?

It is quite important because PC World specifically exclude all rights under the Sale Of Goods Act when the sale is made to a business customer.

Please let me know the answers to the above and I will advise further.

Thanks for your prompt response. I definitely paid with my personal credit card and I spoke to PC World yesterday and they are sending me an exact copy of the original receipt.

Would I be able to go direct to the credit card company and raise a claim based on credit card payment protection for buying faulty items?

Hello Maaz,

You can only pursue the credit card company once you have exhausted all avenues with the retailer.

The credit card company will expect this and will want to see copies of all correspondence that you have had with the retailer.

The best thing to do at this stage would be to wait until you receive the copy receipt and then take it from there.
