Hi all,
My 3 year old Vaio with Geforce 8400M GT GPU is displaying Pink as white. I found your forum by searching tinter web for a resolution to this problem. I bought the laptop from estreetshop via Amazon market place and they are no longer trading. Amazon are the payee on my credit card statement so I contacted them and they say because its a market place seller they cannot help but try Sony, Nvidia or trading standards. I am now filling out the letter to master card for compensation.

Sorry to hear that your laptop is failing.

I cannot understand why Amazon are fobbing you off if they were the payee.

I have to say that it infuriates me when a retailer says "contact Trading Standards" as that kind of attitude does not ingratiate their customers to them does it?

If you paid Amazon then technically Amazon are responsible so I cannot see how they can wriggle out of this.

It is good news that you paid by credit card as this means the card company will have to offer a resolution.

Fingers crossed that it all goes smoothly for you but if you need any help or advice then please let me know.

Thank you for your support I have sent off the pdf form letter to the credit company they say I need to wait up to 6 weeks for a reply and Amazon said to me "Once our Legal Department receives notification of the issue from Trading Standards, they will respond to them directly".

After sending the credit card section 75 letter Natwest have written to me asking for all supporting evidence to prove breach of contract. Please could you advise me on the best way forward.

You will need to send the card company copies of any communications that you have had with Amazon and also a copy of the engineers report. You should also submit a copy of Nvidia's SEC filing which can be found here:- http://yahoo.brand.edgar-online.com/dis ... -11-000046

If you look for the section marked "Product Defect" then you will see information relevant to your claim.

Please ensure that you send these documents by recorded delivery and please keep copies of the documents and the postal receipt.

I don't have an engineer report yet whats the best way to go about that and the Nvidia's SEC filing report link took me to Nvidia's accounts is this the right page?

Hi Paul,
I sent off all the info and bank replied that under the consumer credit act they are not liable because the supplier estreetshop ceased trading and I had not paid direct but via Amazon (this would also apply to paypal or other 3rd parties) so I have to prove Amazon breached the contract. If I had paid direct to Estreetshop it wouldn't apply. Any ideas?

Unfortunately, what they have said is correct. Whilst you paid Amazon they were only an intermediary company and so the actual sale was conducted between yourself and Estreetshop.

This is going to take a little legal advice to see if Amazon can be help accountable in the absence of the actual retailer.

It is my opinion that there should be some form of resolution available from Amazon as they were the payee.

Do you have any home contents or car insurance? If so then these usually come with free legal assistance, which means that you would be able to get a Solicitor on the case and he would also be better placed to advise of the avenues available to you.

As I said, your case is a little tricky and you are now going to need the advice of a professional.

Somebody has to be held accountable for this situation!

Hi Paul,
Have spoken to consumer direct they say my contract died with Estreetshop so basically that's game over and no good going to Sony as I don't have a contract with them and at best they might replace mobo with other defective one if I spend the next 6 months writing/haggling to head office. :b Also tried my free legal advice and same opinion. The laptop is still going and I have bought a belkin cooling mat for it, fingers crossed from now on. :x
