:nh :c Hi thaks for your site and it's efots to help} The Poor B***** Consumers{, who in the face of corperet denial of liability,are being denied and misdirekted as to there rights under the Law :b and the tactics employed may inthemsellves be ilegal?
My HP6735s died as so many others have bougt from Ebuyer April 2009 on 20/10/2011. Hav sent a return request to them quoteing the you tube admishion of inherant fault.
Olso refured to the CPAct and there odigation under it, and in view of them having to setal other clames from there buyers
I was looking to them to make recompence :x '
I am espeshialy gratefull as untill after several googal serch criteria came acros your site is it me or is it my paranoyer you are
being put low on there serch engin?

Hi Pall sent return request No reply.
Have sent enote and rec an auot acnolagement as below.

Date failed:20/10/11

I write with reference to my laptop detailed above which I purchased from
yourselves.
Unfortunately, my laptop has failed due to what I believe to be a defective Nvidia
graphics chip.
I have been in touch with yourselves earlier and requested a return note and have not received a reply.

The laptop is now out of warranty.
I have spoken to a number of people who are very experienced with regard to the
problem my laptop is experiencing and have been informed that this problem is
affecting thousands of laptops.
When I try to start my laptop the error code of 5 flashes of the caps lock LED.

This problem is well documented on the internet and is recognized by HP, Dell,
Apple and Nvidia. Simply Google “Nvidia defect” and you will see that there are thousands of unhappy customers in possession of very expensive door-stops.and the CEO admitting the defect and the reasons whereby poor design is at fault. Along with the directive removing lead from the solder used in construction

I am informed that your company has also reimbursed previous customers who have been affected by this fault upon proof of the defect.
You have to appreciate I paid a lot of my hard earned money for this laptop and
would have expected it to have lasted far longer than it actually did.
I am sure I do not have to remind you of your obligations under Sale of Goods Act 1979
(as amended). As the laptop has failed due to an inherent defect, it is not of satisfactory
quality nor is it durable and so you are in breach of contract.
If I do not receive a satisfactory resolution to this matter then I will have no option but to
take action through the Small Claims Courts.
I am therefore giving you this opportunity to remedy this situation.
I am formally giving you 7 days from the date of this communication to either:-
•Replace my laptop free of charge
•Refund the purchase price of the laptop
If you do not respond in the positive within this time then I will have no alternative
but to obtain an engineer’s report, the costs of which will be claimed from
yourselves.
I will then use that report, along with the myriad articles of information that are available to pursue this matter through the legal system.
Please note that in this matter time is of the essence

Thanks for your fast reply.
As I pointed out in my first note your company is responsible under the
sale of goods act., I am disappointed that you are still trying to deny and
mislead your loyal customers by calming out of warranty and referring to
HP.
Despite already having made previous payments to other customers due to
this defect.
your company supplied the product and the contract was with you and
thereby you are responsible for selling a product with an inherent defect.
under the act.
as I stated you have seven days to resolve or I will instigate legal
proceedings for my los.
please note the latest case PC world where taken to court on 16/11/2011 and
the judge awarded the full purchase prise to the buyer.
so let’s stop this messing about and act as responsible company
should.

Hi Paul hav forwarded comunicatins to Derbyshire Standard Tradeing office enquireing as to wethere they are in breach of the act as you noted in another post? :c persifcaly there rights and disclameing liability whitch is in breach of the act in relation to misdirecting customers as to denying liability witch is an offenc. Will be interesting to see if they agree and take the case on :x

Hello Robin,

Ebuyer are unbelievable aren't they!

Despite the fact that they have settled a huge number of claims involving your model of laptop they still treat their customers in this way.

I would now refrain from contacting them further and would let the seven day time limit pass. Once that has happened I would then proceed to obtain an engineers report.

Once you have that you should send Ebuyer a copy along with a final letter before action.

If they still fail to capitulate then you should sue them.

It seems that this is the only language that they understand.

Scandalous behavior if you ask me.

Hi paul noted that Marchitects contacted them by complantes@ebuyer.com and rec posative responce have forwarded detailes of Enote's to them and awate there reply, as you advise if no mouvement will wate 7 days and instruck my solisiter, :b :x and awate trading standards responce also.

Seams they are operateing two poicies one on site serport and an other in customer complantes by Email?
