Hi Paul,

What a gem of a website, i was just about to smash my laptop against a wall in frustration! Instead i type this on my 7 year old toshiba which still works even if the HP doesnt!

Fairly certain my 6735s has the same problem as everyone elses, purchased from Ebuyer in January 2009.

I am going to start the ball rolling in the morning.

One question for you though. I have files on my hard drive that im wanting to recover in my own time, when sending the laptop back to Ebuyer will they require the hard drive or is it irrelevant?

Hello Des and welcome to our forum.

Glad that you have found us as we will help you reach a positive resolution.

Ebuyer have, in the past, been pretty anal about insisting that the hard drive is returned with the laptop.

Whilst some retailers have allowed the customer to keep the hard drive Ebuyer are not, it would seem, as generous with their willingness to help.

You will therefore need to backup your data prior to sending your laptop in. If you chose ourselves to provide you with a report then I will backup your data to DVD at no cost to you.

There should be no problems in formatting your hard drive and I would recommend that you do this if your laptop contains sensitive data and information.

Besides, the retailer does not need the operating system in order to be able to confirm the defect.

I've had my first reply from Ebuyer, as expected it was very underwhelming and it took longer than 48 hours!

"Dear Tom des Forges,

We have replied to your eNote, number 1338347, as follows :

Dear Tom des Forges,

Thank you for your contact with our Customer Support Team.

Having looked into your query, I can advise that you are covered by the 6 year warranty by sales of goods act, however this warranty covers you with the manufacturer. Please contact HP as they will be able to take this item back for you.

I apologise for any inconvenience or annoyance caused.

Ebuyer Customer Support Team"

Why do they insist on making it so tedious? They've helped others and i stated in my original letter that my contract is with them and not HP!

What a load of baloney!

First of all the 6 year rule is not a warranty but a time limit for bringing an action against a retailer in situations such as this.

Secondly, it is ALWAYS the responsibility of the retailer and not the manufacturer to resolve this situation.

You should now proceed to obtain a report and once you are in receipt you should send Ebuyer a copy along with a letter before action.

If they still fail to capitulate then you should sue them as they really have no defence.

If you would like us to provide you with a report then please let me know.

Hi Paul,

Bit of a strange one this. Their resolution team has been in touch, and this is what they had to say:

"I am writing to you today further to your letter of complaint which has been passed to me to be addressed. First of all please accept my most sincere apologies on Ebuyer’s behalf for any inconvenience that may have been caused with this issue. I can assure you this is not indicative of the usual high levels of service offered at Ebuyer.



Having looked into your query further I can advise that as per the Sales of Goods Act 1979 (as amended) you are able to have the item repaired or replaced up to 6 years. However, this only applies if you are able to provide proof that the item was purchased with an inherent fault or a fault that has occurred due to a manufacturing defect.



We will arrange for the item to be collected and returned to Ebuyer, where the item will be tested and a technician’s report created. Once this has been completed we will contact you within 7 days to advise on an outcome. Please provide the fault description in full for reference.



Please note: if the item is found not to have an inherent fault or manufacturing defect we will return the item back to you, this will incur a £10 delivery charge.



Please can you contact me with a suitable date and address for the collection to take place from and I will action this. We offer collections between the hours of 9am and 5pm, Monday to Friday.



Once again I apologise for any inconvenience caused.

Now im not very comfortable with this idea. Surely its better for me to get my own report first, as they could just say that there is nothing wrong with it?

I would totally disregard that as, under the Sale Of Goods Act, the onus is on you, the customer, to prove to the retailer that your laptop is inherently defective. It is not for the retailer to prove this on your behalf. This is what is known as the "reverse burden of proof".

I would tell them that you are reserving your rights under the Sale Of Goods Act and will provide your own report.

They certainly cannot insist that you should use their services.
