Hello Gary,

What an absolutely scandalous claim to make!

Apart from being libellous it is wholly untrue!

I have rejected may laptops that were sent to me for a report due to the fact they had failed for other reasons.

John Lewis have absolutely no basis to make the unfounded claim that they have and you should completely ignore them.

This is yet another fob off and you should now tell John Lewis that you wish to stand by the report that you have submitted and unless they make you an offer of a settlement then you will proceed to the small claims court and will settle matters there.

I am absolutely furious at the letter you have received and will certainly be taking matters further.

Furthermore, how can they state that the problem only affects a "very small batch of HP computers in the United States"?

This is a worldwide problem affecting all brands. Why else have Nvidia paid out $475 to date?

I can provide irrefutable proof that I have rejected laptops which therefore proves that their statement that "I have a vested interest in telling customers that any and all faults are caused by the Nvidia fault" is utter nonsense.

Little do they know that if a customer sends me their laptop and if it is found not to be defective or if it is found to have failed for another reason then all I charge is £20, which equates to the collect and return carriage.

So in fact I do not have a vested interest in telling all customers that any and all faults are related to the defect as I make absolutely no money on those.

In fact, I actually make a loss as my time is spent testing it and then packing it back up to ship back to the customer.

You should treat that letter with the contempt it deserves and proceed with a small claims action if necessary.

It never ceases to amaze me how low some of these companies will stoop.

What do you think?

Best wishes

Paul

Helo Gary,

Just to let you know I am so furious at the letter you have received I am sending a letter to the directors of John Lewis.

As you kindly posted their letter here I thought it would only be right to post my response to their letter and here it is.

[Letter temporarily removed]

Best wishes

SUCCESS!

Apologies for the late reply but i did secure a "refund" of sorts from John Lewis over a week ago. A short summary of my tale is as follows:

1. After visiting JL to explain the nvidia issue i did not meet anyone who could fully engage with this process and or understood the nature of the case.
2. i wrote to JL head of customer services twice and received absolutely nothing by way of reply.
3. i secured an engineers report and sent this to customer services who offered to refund the cost of the report and £150 toward the replacement i had already bought (costing £500). they also said they had been in touch with HP and that my model was not one of the affected ones.
4. i replied saying that this was not good enough as i had spent over £1200 in 4 years at JL on laptops. the minimum i would accept would be the cost of the replacement for £500. i also provided them with evidence that my model was one of the affected ones (thanks to Paul for that). JL's response was immediate. JL conceded that they had provided poor customer service and would reimburse me £500 but that this was to reimburse me for this poor customer service. it was in no way an acknowledgement of the problem but was a gesture of goodwill.

this leaves a slightly sour taste in the mouth since it would have been nice for them to concede full acceptance of the nVidia defect but at this point i was simply glad that i had at last had some acknowledgement and that this could be resolved quickly.

From start to finish this took about 2-3 months. A massive thanks to Paul for his report and all his assistance and advice on this.

persistence is the key!

Gary

Hello Gary,

Well done on your success. :! :! :! :!

I am really pleased that you reached a positive resolution, though I have to say there was a marked turnaround from them sending you the letter to them offering a full refund the following day.

Still, it all came good in the end for you and that is what matters.
Well done again and all the best for the future. :! :! :! :!

Best wishes

Hello Gary,

Well, I received a letter of apology today for the libellous letter that was sent to you.

I am happy with just the letter and am not interested in pursuing them for a financial settlement as long as they comply with their promise.

Image

They should also be sending a letter of apology to you as well so please let me know if you don't receive it

At least now the libellous statements will cease.

Best wishes

Success from me!

After a few weeks worth of letters back and forth to John Lewis, they are offering a replacement laptop.

They apparently went back and forth with HP and they DID NOT accept that that TX1250ea is an affected model - which is very strange.

I paid £700 for my TX1250ea 4 and half years ago and I am getting a £300 Compaq Presario in replacement - can't really complain with that.

Thanks for your help as always.

Further to my post above, I have just been in contact with John Lewis again to arrange getting my replacement laptop. They are saying that it's an exchange and that I have to bring the faulty unit back. Is this correct? Do I have to give them the faulty laptop back?

Hello Grievearg,

Firstly, well done on your success. :! :! :! :!

I am really pleased that you have reached a positive resolution without the need to proceed to litigation.

John Lewis are entitled to the laptop back as they are replacing it with an alternative laptop so you should indeed let them have it back.

Not everyone has been able to keep their old laptop and many have had to hand it back in.

Do not worry though, it is still an excellent result. :! :! :! :!

Best wishes

Further to my post above, I spoke to John Lewis technical support yesterday.

I was told that they spent an hour on the phone with HP, who have now accepted that that HP TX1250ea model is affected by the Nvidia defect problem.

John Lewis were extremely apologetic for the problems I have experienced and thanked me for my patience with the issue. They had already offered me their cheapest laptop and I had accepted, but they then went back and contacted HP again, which they didn't need to do. Now, I am getting an even better laptop.

John Lewis said, and I quote, "the issue of paying for the laptop is between John Lewis and HP - don't you worry about it".

An excellent result, and evidence yet again, that John Lewis have one of the best customer service policies in the UK (and that HP don't!). Well done John Lewis.

Hello Grievearg

Well done on your success :! :! :! :!

I also have to say well done to John Lewis as well. That type of action is commendable and is not something some of the other retailers would do so credit where credit is due.

I hope you are happy with your new laptop and that it gives you years of faithful service.

Good luck and best wishes for the future.
