Annie,

As you would be reducing the amount of the claim (something that HP aren't likely to object to) then I would try being a little bit naughty and just mention it under the 'any other information' part of the AQ (I think it's part G?)

Just a quick mention along the lines of 'whilst retrieving documentation for this case from storage I have discovered that the amount paid for the laptop was actually £xx I am therefore reducing that element of this claim'.

With a bit of luck it would go through without the need for a formal application to the court.

The garden centre addiction is a bit more difficult. You may be able to add this as a consequential loss but you would need an experts report to prove that it was caused by the lack of a laptop. I wonder if Paul can turn his hand to reports of this nature? :D

Thank you ciderboy - as we have now hatched a cunning plan I will get to it!

In the "other info" part should I mention the inaccurate information given by the HP store people which I took in good faith (or whatever the legal jargon is)?

I have been given Brighton County Court as the venue should we get that far - fine for me because I know it (not that I frequent places like that of course!). The only drawback is that there are so many garden centers along the way..........!

I would just put a bit in brackets stating where you'd got the original figure from and leave it at that - you can always explain fully if it ever goes to a hearing.

I suggest that you start planning a route now which avoids any GC's - there's bound to be a route planner somewhere on the net that'll do that for you. :D

I have posted my reply to solicitors regarding receipts.

I started filling in my AQ (with a view to registering personally in Brighton tomorrow) comparing it with the guidance form on the forum.

I have noticed some strange things about it!!!
In the D section about how many witnesses other than yourself, they have put 1 (one)!!! and in the E section about Experts they have put "No" in all the boxes except the one about "If yes, have you given a copy of that report to the other party" which they have left blank. Therefore if the witness is not an "Expert" who can that person be.......? Are they trying to hatch a cunning plan and if so we had better counteract it! Have they been scrutinizing the forum and thought they would distract me from my mission, and fluster me by inviting Alan Titmarsh? :P Do they really need an army of people to fight a garden center addict ;) which they created?

I will draft my section G now and ask you to peruse please.

Should their AQ answers influence mine?

Ciderboy is the best one to ask regarding the AQ's, though I would say you have absolutely nothing to worry about. If the other person is not an expert then they could just be a spokesperson?

Furthermore, if they have not inspected your laptop to try and refute my findings then they have absolutely no defence.

I wouldn't say it is a cunning plan though. Do I detect a hint of paranoia setting in? :lol:

I am still confused as to why no-one from HP or elsewhere has tried to talk to me or negotiate! I don't want to FORCE them to take my telephone number - that would look too desperate...!

If the Witness is a "spokesperson" - don't they have to be reasonably articulate - unless it's to explain to the judge the appalling quality of defenses they have been filing!

That sounds to me like the work experience lad has been given this to deal with. :@

If I were you I'd write to them directly asking for details of the witness they intend to call and why they are being called.

Hello Annie,

I agree with Ciderboy. You should contact the and ask why they are bringing a spokesperson and what evidence will they be bringing.

If HP are to introduce anything into court on the day they must make you privy to this before court date.

If they do try to introduce any evidence that they haven't already made you aware of then it will be inadmissible.

You have me intrigued now. :P

AQ in to BCC this morning Friday 30th - I paid the £35 even though the claim was reduced (at the advice of the American man dude ..!!!! behind the counter. Very blingy - big gold rings on his hands and heavy gold chain around his rather plump neck..8-) ) so as not to hold things up.

Emailed solicitors to request who their witness was and what evidence he/she will be presenting (I presume I am allowed to know this info?) - no reply yet even though email was sent very early. They probably didn't know they HAD a witness so are in a little frenzy :shock: trying to work out who it might be! If they do not reply again it will look even worse - especially as I have attached the letter sent yesterday explaining defendant's gaph in giving me incorrect info.

Hopefully will get some response next week when they recieve my AQ and all the trimmings with it! Oh - and I managed to avoid all garden centers but got very led astray in the Brighton Lanes :oops: But what the heck, the sun was shining, the sea was blue and the "law man" was extremely civil and helpful - and the black americano with an extra shot of expresso, taken in the sea air was ever so invigorating!!

Thank you Paul and ciderboy for all your help - I feel we could be nearing the beginning of the end?

No problem there - nothing they present at the hearing should come as a surprise to you (and vice versa) - openness is encouraged in the hope that it will lead to cases settling
