Hi,
Please can anyone help. I brought a hp dv9702EA in april 2008. Which is over 2 years now and out of warranty. I am currently having problems with the screen now as the brightness has gone down and horizontial lines flickering on the screen. I took the lap top to a local computer repair shop who advise the graphic card is the problem and not the screen. I later discovered the problem with hp and the graphic card ndivia from web sites such as yours. I have read the step and what you need to do, but have some question. Could you tell me if i have a case from what is happening to my laptop and will qualifi for any refund or exchange.

I brought the laptop on credit card from currys digital in birmingham city centre, but noe has closed down. I went to the next local currys by me and explained my rights and was advised to email or right in to the customer service dept as they couldn't make a discion from store level. They also advised that if needed they would contact their head office. They guy that advised me was quite helpful and mentioned I would need to prove that the laptop had a fault from the start rather than happend while using. I also mention that is has been docmented on the net that there has been a design probelem with hp and defected ndiviea graphic card. He advised it might be wise to include document, links that show this. Also if possible case ref, examples where the dixions group have gone to court and loss and comments against them.

Please can you help and advise.

Hello Mostak and welcome to our forum.

Sorry to hear of the problems you have been experiencing with your laptop.

It is good news that you paid by credit card as this means that the card company is also responsible along with the retailer for the inherent defectiveness of your laptop.

What you need to do is to send a letter before action to Currys head office. A template can be found here:- letter-to-send-to-retailers-head-office-prior-to-action-t134.html

You should download that, edit it with your details and send it to Currys head office.

This gives them seven days to respond. If they fail to do so you should then obtain an engineers report. Please let me know when you get to that stage as this is a service we provide.

The cost of the engineers report is recoverable from the retailer.

Once you have the report you should send a copy to Currys head office along with a final letter before action.

Please ensure that you send all letters via recorded delivery and ensure that you keep copies of the letters and the postal receipts.

If they do not respond positively to the final letter before action then you should sue them via the small claims courts.

The process is very simple and has been used successfully by numerous forum members.

I think you may find that they will make you an offer once they have received the report.

hi Paul, thanks for your quick response.

i was also given a email address. is it wise to email. The details i was told to reply to was a customer services dept for currys. Should I ask for their head office instead.

Also from what i have mentioned on the faults on my lap top, do you think a qualify for a refund.

To be honest I have always found it best to communicate via letter - that way they cannot say that they have not received your email.

Furthermore, it is always best to send the communications to their head office rather that the customer services email address as you are more likely to get them to jump into action once the recorded delivery letter hits their doormat.

Well, if the problems you describe mean that your laptop is inherently defective then yes, you will qualify for a refund.

Hope you are well.

If you dont mind me asking, In your opinion do you think that I have a case and worth me doing this.

The head office number I was give was Dixon Stores Group Maylands Avenue, Hemel Hempstead, Hertfordshire HP2 7TG. Does that sound right to you.

Also in your letter, should i edit and put other facts in, or should i keep to you format and only edit address, models etc.

Well, if your laptop is inherently defective then it is certainly worth pursuing this as you cannot lose.

The address you have been given is correct so you should send your letter before action to that address via recorded delivery.

I wouldn't change the letter before action and would just send it as it is with just your own address details and laptop details entered.

hi paul,

i have a hp DV9702EA TL602G and not to sure what grahpics card it is apart from ndivia. Does this model qualify. Should i also put the reciept number as well.

Hello Mostak,

The model number of your laptop is completely irrelevant. As I mentioned previously, if your laptop is indeed inherently defective then you would qualify for a refund or replacement laptop.

I wouldn't worry about the model number of your laptop and would instead concentrate on the fact that your laptop is defective as that is all that really matters at the end of the day.

Rest assured this defect is not model specific.
