Hi,

Just want to check mine is on the defect list before I proceed,

I purchased the laptop in Comet on 26/07/07 the serial number is CNF7162N5D it has the NVidia GeForce Go 7200 graphics card. After 3 months of owning the laptop, the laptop died on me. I took it in store to Comet and it was sent away for replacement with a new motherboard.

It is hard to remember the exact dates of when I sent the laptop back and why .

I think the laptop worked for another 6 months before I sent it back again for another black screen failure. This time they said it was the NVidia Graphics card and it had been replaced. They gave me another 2 years warranty for this problem.

A year ago it died on me again and I contacted HP. I sent it off again to be fixed. I then restored it myself after the HP wireless assistant stopped working. I have replaced the keyboard as the '5,6,t and y' keys had stopped working. The battery is not holding its charge and after buying a replacement battery it is still not, as it seems to be a problem with the charging part of the motherboard. The screen has now blacked out and it only works through my external TV monitor.

I have rang HP and they tell me that I am out of warranty and will have to pay £17.50 for someone to even listen to my problem. I have followed step 1 100 times in the past and believe I will get nowhere with Comet. Therefore I would like to know where I stand with this and what my next steps should be.

Any help is appreciated!!
Even if my situation is at a loss I would still like to insult HP and Comet as much as possible so I'm glad I have found this website.

Hello Winstan and welcome to our forum.

Sorry to hear of all the problems you have been experiencing with your laptop.

In America your laptop would be called a lemon and as such would be covered under the "lemon law"

Here in the UK we are lucky enough to have protection with the Sale Of Goods Act and the good news is that your laptop contravenes this law in many ways.

The Sale Of Goods Act states that goods must be:-

1) Of Merchantable Quality (Yours obviously isn't)
2) Free from minor defect (Yours obviously isn't)
3) Durable (Yours obviously isn't)

It has been proved that repairs to your laptop are fruitless and unreliable as is evidenced by the expeditious failure of your laptop.

You will have no problem in securing a resolution against Comet, it is just that Comet being Comet it will take some time.

The two important points to note are:-

1) Comet are the ones that are 100% responsible for resolving this situation. You should not bother pursuing HP as your contract is with Comet.

2) You have six years from the date of purchase to take action against a retailer when the goods in question are inherently defective. The status of your warranty is irrelevant.

I suggest that you download the following letter before action:- letterbeforeaction.pdf

You should download that, edit it with your details and sent it to the following address via recorded delivery:-

Comet
George House
George Street
Hull
North Humberside
HU1 3AU

Please ensure that you keep a copy of the letter and postal receipt.

If after seven days they failed to respond then you should obtain an engineers report that will prove the inherent defectiveness of your laptop. Please let me know when you get to this stage as this is a service we provide.

Start off with the above and see how you get on then pop back here and let me know and I will advise further.

Hi Everyone,

I have sent the letter before action about 10 days ago and have still not had a reply. Please can you tell me what I need to do for the engineers report stage. I would just like to add for anyone following that during this time a config file on the laptop became corrupt after the power failed and now the laptop will not even load into XP. So more abundant joy from this failure of a laptop.

No surprise there Chris. They are probably so inundated with claims that they have a massive backlog.

Still, this is not your problem as they should take on more staff to cope with this situation.

Was the last line of your letter "In this matter time is of the essence"?

Hello Chris,

That letter is quite common and the next response that you get from them will probably be along the lines of:-

Quote:
After consulting with HP they can assure you that your laptop is not one of those affected by the defect.


Judging by the responses that members have had after providing the self same information the above is about
on par with what they will say.

It is at that point that you will then have to obtain an engineers report in order to be able to proceed with a claim against them.

Please let me know when you get to that stage and I will advise further.

Sorry for a long time with no update. I wanted to check that Comet weren't just bullshitting me.

I have a success!!!! They sent me the letter I have attached. So result I am now typing to you on my new MacBook!!!

Your draft letter threatening action strikes fear into everyone at Comet, you can kind of tell by their reaction to this. I hope this gives everyone else with the same problem the inspiration to keep fighting. With just a month of effort I have received every penny back of the £650 I spent on that terrible laptop.

Hi guys
I have just joined after finding the website yesterday.
I have an hp dv6331eu bought from comet around august 2007 and have had the usual problems
1st the wireless went followed by the display I phoned hp who agreed to repair it even though it was 6 months out of warranty.Now the same problem has returned with the display not coming on and getting 1 long beep then 2 short from the bios.At this moment i am unable to find the receipt can you tell me if i can still pursue comet without it.

Hello Stevie and welcome to our forum.

Sorry to hear of the problems you have been experiencing with your laptop.

The problems you describe are all manifestations of the defect. In fact, the 3 beeps that you can hear is the POST(Power On Self Test) error code that relates to a failed video.

How did you pay for the laptop?

Was it by credit or debit card?

If it was by credit card then you would have extra protection as the card company is jointly liable with the retailer.

Regarding your receipt, this is not really important. What is important is that you can prove purchase. If you paid by credit/debit card then you could show the bank statement and that would suffice.

Alternatively you could simply contact them and ask for a copy receipt and see what they say.
