Good morning...

WHAT DO I SAY TO COMET NOW????

I have just recieved a phone call from the directors office at Comet saying that they want to resolve this matter outside of court and are offering me a free repair by replacing the motherboard with a new one that has a new batch of Nvidia chip free of the defect.. Or so HP have said....

I told her that I would contact her with an answer but just wanted guidence on what to say..... I cant believe that they are now offering me a free repair after all the time and money I have spent getting to this point.

I dont want anything more to do with Comet so I dont want want to accept the repair and dont think this is an acceptable resolution. You can garantee that they will also do the BIOS update so the fans stay on all the time, which I dont want.

Hello Craig,

How typical of Comet is that!

I would tell Comet that you will accept the repair on the following conditions:-

1) That they give you a written guarantee on Comet letter headed paper that states the following:-

"The mainboard being used to repair your laptop is from a completely new batch and is 100% free of the Nvidia defect. If, at any point in the future, it transpires that the mainboard is inherently defective due to the Nvidia GPU, then a refund or replacement laptop will be offered"

2) That they provide you with the part number of the mainboard that they intend to use

3) That they guarantee that the mainboard they intend using does not have the BIOS update that switches the fans on 24/7 to the detriment of the battery.

If they provide you with all of the above then you would have to accept their offer of a repair.

Will they do this? Well, they haven't to date which only begs the question why not!

I would be very interested to know the part number that they intend using, though I would bet that they refuse to give you this information.

The two guarantee's are very important and pivotal to your ability to make an informed decision as to whether or not to accept their offer of a repair.

I would get back in touch with them Craig, ask them the above and see what they say then please pop back here and let me know.

What should I say regarding the court fees and the engineers report that total £125 that I will lose out on if I accept the repair?

The consequential losses that you have incurred to date should be refunded even if they offer the repair.

Are you considering accepting their offer of a repair?

They cannot refuse to refund your losses so don't let them even try that one.

I am not going to accept the repair unless they can give me the correct answers and guarantees to the questions you have gave me and the money back that I have spent up until this point....

Good morning,

I have spoken to Comet and they are agreeing to send me a letter stating the two guarantees you provided and are going to refund me all my fees that I have ask for in the court claim...

I was surprised that they are giving me a 100% written guarantee that the motherboard is free of the defect and that if it failed they would give me a refund/replacement laptop....

I am just waiting on the letter from the directors office and will let you know what exactly the letter states... If it is all in the letter then I will have to accept the repair....

Well that is a turnaround, considering that Comet have steadfastly refused to put anything in writing.

I would be very interested to know the part number of the mainboard that they intend to use.

We will see what their letter states. If, as they claim, it provides the guarantees, then you would have to accept their offer of a a repair.

Hi,

I did ask for the part number but Comet have said that HP wont issue that out.... My betting is that the chip is not 100% defective free and that is why they wont issue the part number but have told comet it is.....

As long as I have it in writing that it is 100% free and a refund/replacement will be issued if it failes again then I cant really complain, although I would much prefere a new laptop....

Hopefully a letter will arrive before by the end of the week....

Well, call me cynical but in my opinion that sounds really suspicious.

What have HP got to hide? What is so secret that they cannot let you know the part number?
I would say that the part number would be the thing that would enable one to determine whether or not what HP are saying is correct.

Did you ask about the BIOS update and whether or not your replacement mainboard will have the same update insofar as the fans will be on 24/7?

That is the last thing you want if you don't mind mind me saying as if it is the case that the fans run 24/7 then that means the board is unable to dissipate the heat adequately.

There is a way that this can be checked though Edward. Would you be willing, if you accept the repair, to allow me to re-inspect your laptop to check the part number and lot number of the Nvidia GPU? I would pay for the cost of the collect and return carriage so it won't cost you a penny.

That way we will be able to tell once and for all whether or not HP's claims are correct that they are using "newly revised" boards.

What do you think?

Hello,

I did ask the BIOS update not to be done on my repair and the lady i spoke to said that she has not heard of that update but will guarantee that it will not be onto my laptop... I suppose the only way to prove that is turning it on and listening for the fans...

I am happy to send it off you if I accept the repair but what would happen though if you come back to me saying that the motherboard still has an infected chip and the fans are running 24/7?? Would this mean that they are in preach of the guarantee and can have a refund/replacement straight away???
