Hi Paul,

good afternoon,

thanks for yr last post;
just as a quick curiousity , if you have a clue: with the claim, on Money Claim Online, what am I supposed to do now ?
It has not been closed or updated since the hearing date was booked... do you know if i am supposed to archive or delete it (these are the only options i found) or what else?

Hello Federico,

I would give the court a quick call and would tell them that you have reached a resolution with the defendant and that ou you now like to cancel your claim.

There should be no problem in doing this.

... on the hearing day I called the Court and they told me to fax them informing (with the case reference) of the agreed solution of the case;
I did that , but the case is still there as it was.
I had the feeling that they didn't know so much about the claims open online.
However , i will call the court again.

Good afternoon Paul,

I see that there was a new winning case after mine... so the show goes on !

I'm writing this time , becuase even the claim closure starts becoming a problem.. today ,talking with the Court services I had like the feelings to be talking to Comet.. not good ones.

Schematically:

1. On the of the hearing the Court told me to send a fax to inform that the case was solved via agreement with the defendant; in that fax, I also requested the claim to be closed.

2. after one week I saw that the claim on line was still open , untouched, as if nothing happened;
More less in the same days I got a letter from the Court stating:

" Before District Judge NameOfTheJudge sitting at Name&AddressOfTheCountyCourt.
Upon reading a letter from the Claimant and the defendant not attending

IT IS ORDER THAT

- Hearing of the 18th February 2011 vacated
- No order in the claim

"


and nothing else in that letter.
What it means exactly , I have no clue. What I am supposed to do or what is going to happen.. no idea.

I called back the court , one agent told me that to get the case closed I had to specify that the case was "settled". So he told me to send a new fax , I did that and I specified again to close the claim.

3. After one week , TODAY, I logged on Money Claim Online and I see that the case is still open and in the same status, untouched for more than one month.
I called back again, at the beginning they told me to wait in hold, cause they needed to reboot the system, then the agent added the she didn't know what to do with that case , even if she confirmed about the reception of my last 2 faxes. I replied to close the case and she said she didn't know if she could do that.
I requested to escalate to her manager, but nobody was available at that moment. She suggested me to callback.
So I went in person to the Court , few hours ago.
Same story at the counter, they confirmed that they case was "settled" , so for them, they said, it means closed , but that they had no power to interact with the system online, where the claim is showed open.
So I requested a written confirmation that the claim was actually closed; they replied that they couldn't provide a written confirmation, without my written request for that. So I accepted to put in writing my request, at the same time the made me speak to a manager, as per my request.
The manager said that the letter i received from the Court was the confirmation that the case was closed.
I showed that letter to the manager:
not only there wasn't stated anywhere that the case was closed (as you can see above in this post), but neither settled, neither that they received any request from me to close the case.
She also added that she couldn't provide any written confirmation that the claim is closed.
Their explanation were not reasonable to me at all.
Sorry but I had the feeling that they understood exactly what i was asking for , but that, for whatever reason, they couldn't or didn't want to satisfy my request or explain why it couldn't be satisfied.
In the end the manager suggested me to write a letter , addressed to the judge , with the request of written confirmation that the cliam is closed and he will decide. Did that , now there are other 2 weeks to wait.

Is that pure madness?

Please let me know your opinion.

Hello Federico and I hope you are well.

I wouldn't worry too much about the online status of your claim.

You have done what was required of you by sending in the letter etc and so the online status of the claim is a little irrelevant.

Ciderboy should be able to advise more concisely if and when he see's your post but I think you will find that the letter you have will be enough to confirm that the matter is indeed at an end.

Sorry, I've not been about much the last few days.

Basically the online court system and the in-court court system are two different entities.

Normally when an on-line claim gets transferred to a local court then the on-line claim is closed down (presumably it shows as having been transferred to your local court?)

The order you've received, whilst poorly written, indicates that the court are aware that the claim is settled.

I'm not sure why the court wouldn't give you anything in writing to confirm that the case was settled (particularly as you are the Claimant) but the information they gave you about being unable to interact with the on-line system is correct.

Basically I would just leave it.
