Hi,

My laptop has just failed and I came across this site whilst hunting for tips on fixing it.

It won't power on anymore. The lights briefly light up when pressing the power button but then go off again. I thought it was related to overheating but looking at the other posts here it seems it could be related to the Nvidia defect. The DVD-Rom stopped showing up on it about 6 months ago, even though it was getting power and spinning up. My research at the time suggested that was due to a motherboard fault.

I bought it in January 2008 so it's about 3 and a half years old so I wouldn't expect it to have worn out by now.

I'm hunting around for the receipt now but bought it on my credit card so have requested proof of this transaction from my CC company.

Does this sound like a situation where I have any grounds for a claim?

Hello Smossifer and welcome to our forum.

Sorry to hear that your laptop has failed.

The problem you describe could be related to the defect, though it is difficult for me to state definitively that it is definitely inherently defective.

I have seen that form of manifestation of the defect many times so it is likely to be the defect.

It is excellent news that you paid by credit card as this means the card company is jointly and severally liable with the retailer in situations such as this. What this means is that if you don't get a resolution from the retailer then you can claim a Section 75 refund from the card company.

Once you have found the receipt or bank statement you should contact the retailer and should tell them that the laptop has failed with what you believe to be an inherent defect in the Nvidia GPU.

They may tell you that your laptop is out of warranty and that there is nothing that they can do. You should tell them that the warranty status is irrelevant as you have six years from the date of purchase in which to bring an action against a retailer when the goods in question are inherently defective.

They may then tell you to contact HP. You should tell them that you purchased from them and not from HP so it is entirely their responsibility to resolve the situation.

Thanks for the info. It's really helpful.

From what I've read on this forum it looks like I would only get a partial refund from the shop due to the period of time I have had the laptop.

I've now found the statement for it, but unfortunately I paid on debit card. The full amount is £507.49 which sounds a bit much. I may have bought something else at the same time. I'm going to call into the shop tomorrow to ask them to look on their system to check if I bought anything else at the same time.

When you get the laptop back it will be in working order (albeit for an indeterminable amount of time) so you would easily be able to backup your data.

Alternatively I could do this for you and backup onto DVD if you so wish.
