On the 29th July 2007 I bought a HP PAVILION DV9399ea Laptop through COMET on line in Hull,I paid with my HSBC Mastercard. In early Dec 2009 I turned my lapton on only to find a black screen, a engineer test it on the 12th Dec and comfirmed that the mother board had failed, I contacted HP who said go back to Comet. On the14th Dec I phoned Comet on 0844 8009595 and spoke to Amy in customer services (she said she was the only Amy in customer services) I explained the situation to her and she said under a 6 year obligation this matter could be dealt with,as it was a known fault with the HP laptops. She advised me to take the laptop to the Weston super Mare store and pay the sum of £45.00 for Comet`s engineers to confirm it was a fault with the mother board,she advised me that providing it was confirmed to be the mother board that I would have my £45.00 refunded and that I would have a credit of £1199.99 with which to purchas a new laptop or other goods.
I duly went to the Weston super Mare store and spoke with manager Tim who was most helpful and seemed to know a little bit about problems with these laptop`s He had to ring Amy in customer services as he said the price was £49.99 and it was Amy mistake over the price ,I agreed to pay the £49.99 as I was told I would get it back.He filled out a customer repair document Job No 4175658 Fault.. black screen does not boot into bios or though to, Additional Fault Info He put the following hp apparently have a agreement with comet on this model no. due to the amount of returns-please inspect and contact hp to arrange write off/repair
So far so good.
On Christmas eve Matthew from the repaire center telephoned me to confirm that the motherboard was in fact defunct.He advised that a repair could be done for £185. 45 plus the £49.99 I had paid for the engineers report. I told him this was not what Amy in customer services had agreed he waited on the phone while I phoned customer services it was Amy day off no one eles would help, so I asked Matthew to return the unit to Weston super Mare store.
Now things not looking so good
I called into the Weston super Mare on the 9th Jan and spoke to a helpful gentleman he went and spoke with Tim the manager and came back and said Tim could not sort this out on a Saturday but would sort it out next week, I heard nothing so Tuesday the 19th Jan I went back to the Weston super Mare store and saw Mark who was very helpful and asked if I could speek with Tim the manager but was Tim was now in Barnstaple Mark was kind enough to speek to Tim In Barnstaple and Tim told Mark to referr to Amy in customer services. He spoke to Amy in customer services and after ,he said Amy would only agree to a refund of the £49.99.
Feeling fed up I sent a Letter to Comet head office and told them the story so far, I asked for a credit for £1199.99 and a refund for £49.99 as agreed with Amy in customer services on the 14th Dec I sent this letter on 21/01/10 .I recived a phone call a few day`s later from a lady from the managing directors office and she said I could have a discount of 35% off the repair and that she could find no Amy in customer servives asked if I new her surname.
I few day`s latter a got a letter from comet .In it ,it said I would get a 35% discount of parts and have to pay £45.00 labour.
But the best part of the letter was Vivian Tamburrini Managing Directors office can not find Amy in customer services .

Hello 69bugs and welcome to our forum.

Comets behaviour towards customers is really becoming quite tedious.

I have heard of numerous customers who have paid Comet £49 for their "inspection" only to be told that the motherboard had failed and they would be offered a discount on the repair.

Once you realise how these characters operate you get to see a pattern and can advise customers of what to expect and the action they should take.

Firstly you should disregard everything that Comet tell you as the bulk of what they say is meaningless drivel with no foundation or basis in law.

Once you have your report that states your laptop is inherently defective you should give them seven days to respond in the positive.

If they don't then you should sue them through the small claims courts via http://www.moneyclaim.gov.uk

Comet's behaviour towards customers struggling with this problem is nothing short of disgraceful.

They have incorrectly told customers that even after receiving a report that proves conclusively that the laptop is inherently defective the customer will still have to contribute towards the cost of repair.

They have said that even after receiving a report the customer will have to pay £49 to have the laptop inspected by them.

Total rubbish.

Once you have a report that states your laptop is inherently defective Comet's options are limited.

If they want to inspect the laptop then they are quite at liberty to do so but they have to arrange collection. They cannot insist that you take the laptop to a store.

You can insist that they send in a courier on a day to suit yourself.

Under no circumstances should you allow them to perform a repair unless they are prepared to give you a written guarantee.

The written guarantee should be on their company headed paper that states the following:-

"The mainboard being used to repair your laptop is from a completely new batch that is 100% free from the Nvidia defect. If at some point in the future it transpires that the laptop is inherently defective due to the Nvidia GPU then a full refund or replacement laptop will be offered"

They probably won't offer you such a guarantee because nobody knows which boards are defective and which are not.

I am going to issue a County Court summons on the 19th Feb against Comet and this is my claim:-

I purchased my laptop, a HP DV9399ea on 29/7/07 at a cost of £1199.99 from Comet. On 12/12/09 my laptop failed due to an inherently defective Nvidia GPU. This issue is affecting thousands of laptops worldwide and is a known fault. On 14/12/09 Amy from customer services agreed to a refund if the fault was confirmed by Comet engineers. On 23/12/09 Comet confirmed the fault and offered a chargeable repair. This was not agreed or acceptable. I have sent letters to Comet requesting a refund/replacement and comply with Sale of Goods Act.
An independent report confirms the defect dated 18/02/10, it states it is impossible to repair the unit as to guarantee the inherent defect has been removed.
Having exhausted all other means, I am now forced into this action. I claim the cost of the laptop, reports and costs totalling £1384.98. I also claim interest under section 69 of the County Court Act 1984 at the rate of 8% per year from 12/12/09 to 19/02/10 of £20.40 and also interest at the same rate up to date of judgement or earlier payment at a daily rate of 0.022%.

By my reckoning this is exactly 24 lines in the size of box they give you on the court form and 1075 characters.

I would be grateful if anybody could give advice or any suggestions for improvement before I commit to sending this at lunchtime tomorrow. Thanks.

Good luck, it is just a waiting game now.

To be honest, this is the bit I hate the most. Waiting for the court date etc. Sometimes it is best to forget about it until nearer the time otherwise I find that it can eat at you.

They will pay in the end though, it is just a matter of when.
