Hello Hm671 and welcome to our forum.

Sorry to hear of all the problems you have experienced with your laptop - what a nightmare!

When sending your letter you should initially request a full refund as this gives you a better starting position to negotiate on the actual amount that will be paid.

You probably will not receive a full refund but you could argue that due to the number of times the laptop has been repaired that you have not had unhindered use and so this should be taken into consideration when calculating the refund.

You could also say that you would be happy with a replacement laptop of the same value as it is quite plain that 3 replacement mainboards and a fourth one that is currently failing mean that your laptop is a lemon and should never have been sold.

Hello HM671,

Yes, you should also claim back the cost of the Extended Warranty as they cannot charge you for a warranty on an inherently defective laptop.

Who did you pay for the extended warranty? Was it paid to the retailer?

If you can let me know the platform number of the laptop then I will let you know if it is on HP's list. This is the P/N number from the white barcode label on the underside of the laptop.

Your laptop is indeed on the list and that can be found here- just-some-of-the-laptops-that-hp-admit-are-defective-t1018.html

You should also claim back the extra years warranty that you purchased as HP cannot sell a warranty on an inherently defective product.

The fact that your laptop is on HP's list means that you have no problem in proving that your model of laptop has been recognised as being inherently defective.

This is excellent news for you and means that John Lewis should not put up too much of a fight.

Thanks for all your info Paul. May I ask where the list you have posted was published and when? Just cuz I cant see my unit on your screenshot of the HP page here: hp-limited-warranty-service-enhancement-gone-from-website-t917.html

If HP had published this prior to December 2008, they should have never offered to send it to repair a second time round.

I'm preparing my letter to them as we speak :D

There was an update to the list that you refer to but unfortunately, in HP's infinite wisdom, they removed it from their website.

They did this, they claim, because the class action in America had been settled.

There must be a copy of the PDF flying around on the internet somewhere but I have yet to find it so cannot state definitively when this list was released. I agree with you though that HP should have immediately ceased the sale of all laptops listed.

You said you were preparing to send a letter to "them". Did you mean John Lewis as there is no point in sending a letter to HP as you contract is with John Lewis.

JL may try and fob you off to HP but as I stated, you purchased from JL so it is for them to resolve the situation.

I hope you don't mind me pointing that out.

Hi

I have the same model purchased from John Lewis in May 2006. In January 2008 I had a blank screen, it was still under warranty and John Lewis sent it away to be repaired. Faulty graphics chip and motherboard was replaced. I have had intermittent problems (losing wireless etc) for some time. Tonight I came home, turned on my laptop, wireless was missing. I did what I always do, went to recovery manager and reinstalled the wireless driver. The laptop then tried to reboot and I got the dreaded beeps and blank screen I had when it broke down before.

Where do I start? Any help is greatly appreciated. I constantly work away from home and rely heavily on my laptop. I only came across your site tonight and can't believe my eyes

Sorry to hear that your laptop has failed.


I did a quick check on the HP website to see if I could find any further information relating to your model of laptop and found this:- http://tinyurl.com/4byh4a5

This is the BIOS update page for your laptop. On the 25th March 2008 HP released a BIOS update for your laptop named F.51.

The purpose of this update, according to the HP Support Site, is:-

Quote:
Updates the fan-control algorithm for the system to reduce the likelihood of future system issues.


So, HP knew from as early as the 25th March 2008 of the potential for your laptop to overheat - otherwise why release a BIOS update that switches the fans on continuously to the detriment of the battery?

Your only problem is that you have had the laptop for five years which means that your refund would be limited and so your only option would be to accept a repair.

Whilst I hate having to advise this as I know the defect exists in spare parts as well as laptops, but I don't think that you have much of an option.

Have you contacted John Lewis yet and if so what have they said?

The BIOS information that I mention above will greatly help your case.
