Hi Paul,

I have same problem with my laptop same model and part number. Purchased from JL on 30-06-2007, It has got repaired twice while under 2yr warranty from JL. Can't remember dates of repair. But as it is less then 5 years is there any chance of getting any where with JL.

If your laptop is indeed inherently defective then you would have every chance of a success against JL.

Do you know what they did to your laptop when they repaired it?

Do you still have the work dockets?

Answer to your question below:

Do you know what they did to your laptop when they repaired it?
I think 1 time they just upgraded the BIOS and on 1 occation they had to replace the mother board.

Do you still have the work dockets?
I have to check my paper work but likely not.

Please could you also let me know exactly what problems you are currently experiencing?
When booting it beeps 1 long 2 short beeps, suggesting graphic card issue. Whihc is well documentd problem with this model.

Hello Esitaas

The three beeps that you hear are a POST (Power On Self Test) error code which signifies a failed video.

Don't worry if you cannot find the work dockets as HP will have a record or your serial number and the work carried out.

The fact that your laptop has had two mainboards in its short life will further enhance your claim.

I would now contact JL and would tell them that your laptop has failed due to an inherent defect in the Nvidia GPU.

They may tell you that your laptop is out of warranty and that there is nothing that they can do. You should tell them that the warranty status is irrelevant as you have six years from the date of purchase in which to bring an action against a retailer when the goods in question are inherently defective.

They may then tell you to contact HP. You should tell them that you purchased from JL and not from HP so it is entirely JL's responsibility to resolve the situation.

If you follow my advice in that guide then you will be successful.

Hi Paul

So...my laptop decided to start again but it was shortlived. I have since contacted John Lewis. I also found my receipt and I actually bought it in May 2007.

After almost a week of back and forth calls, here is the short version of what's happened.

John Lewis say they are happy to replace my laptop if I can provide the ORIGINAL engineers report from my repair in 2009. I have moved cities and it's highly unlikely I will find this.
Apparently, neither John Lewis or HP have any record of my laptop being repaired, even though it was still under warranty with JL, was with HP for almost 3 months and was couriered back to my home address.
They say they are willing to pay for half my repair as a 'goodwill' gesture. However, unless I can provide the original repair documents that prove there was a previous fault that's as far as I can go. As you can imagine this conversation went round in circles for quite some time.
I have asked for their head office contact details, do I go ahead with your template letter or can you advise me further?

Hello Esmaj,

How on earth can they expect you to still have a repair document that dates back almost two years?

It is wholly unreasonable of them to insist on this when they themselves have lost the repair record.

In any event, the fact that you have already had a repair to the laptop is kind of insignificant as if your laptop is indeed inherently defective then that is all that really matters.

I would now contact John Lewis and would tell them that you are not happy with their response and unless they are willing to either replace the laptop of offer a refund then you will have no option but to obtain an engineers report. You should further tell them that once you have the report you will send them a copy to give them a final opportunity to make you an offer of a resolution. Failure to offer a resolution at that point will result in you filing a small claims action against them.

Try the above and see what they say then pop back here and let me know and I will advise further.

Hi Paul

I sent my first letter to John Lewis yesterday and am awaiting a response.
However, I have had an unexpected event since I sent the letter...I found the repair docs!
The laptop was returned to me in November 2008, the report states that the system board was replaced.

I'll wait for JL to respond and go from there. At least the ball is rolling now.
Do you have any advice in the meantime?

Sent the letter before action on Monday as per your advice.
John Lewis called today and offered me a full refund. No engineers report, no questions.
They were extremely apologetic and lovely to deal with.
