Hi

I have a HP DV 2630ea that started failing last year, but HP said they couldn't help, this summer it failed completely, and HP finally told me I had to go back to the retailers, PCWORLD, so I did,
The know how team have picked it up, and after me chasing them 4 weeks later told me it is unrepairable and offered me £260, I refused as I originally paid over £700 (Xmas 2007),
And when I said I wanted to speak to a manager it was upped to £324, I again refused!
I'm still awaiting a call back, now 5 weeks later after them taking my laptop!

I was wondering should I keep pushing for more, as they should have looked at it last year!

Where do I stand?

What are my chance?

Any advice would be much appreciated!

Hello Dodo and welcome to our forum.

Sorry to hear that your laptop has failed.

You laptop contains an Nvidia 8400 GPU (GPU REV G86-630-A2) which is widely reported as being defective and is failing in huge numbers.

On the 8th April 2008 HP released a BIOS update (F.2A) for your model of laptop which switched the fans on continuously. This proves that as early as April 2008 HP must have known of the potential for the premature failure of your laptop.

Please could you let me know the exact date of purchase, exact purchase price and the date that you reported the failure.

Once I have this I will be able to correctly calculate the minimum amount of refund that you will be entitled to.

Hi thank you for your swift reply!

Going on my records it was purchased 08-12-2007 at a cost of £699.99 (reduced from £720 as we took the extra warrant),
And the first time I emailed HP about it was August last year going on my email acc, although I think it was before this as they kept emailing me about batteries over-heating, Which I replied to to be told mine wasn't affected, although my laptop was seriously hot, I have emailed HP to see if they have any records.

The problem is I reported this to HP but I originally bought from PC World, and
they are who I am dealing with now!

Hello Dodo1980,

You will need to ensure that from now on you concentrate all your attention on PC World as they are the ones that sold you the laptop.

You have stated in your post that you took out extra warranty. As your laptop is inherently defective you will also be entitled to a refund of that warranty. Is that amount included in the £699.99 purchase price?

You have stated that you purchased in December 2007 and you have also stated that the laptop failed completely in the Summer of this year.

Whilst you did email HP in August of last year you didn't email PC World, which means that as far as they are concerned the date of failure is the date that you reported the failure.

You would not generally receive a full refund but rather a pro-rated refund, which is a refund that has been reduced according to usage.

If we were to take Summer of this year as the failure date then one could say that you have had 3.5 years usage and so would be entitled to a little under half of your money back.

Based on that I would say that their offer is in line with what you would expect to receive back.

If you have emails from HP where the inherent defect is discussed then you "may" be able to get PC World to increase their offer, but this is not guaranteed.

To be honest with you I would be inclined to accept their offer.

I did think this, but I was wondering if there was anything I could do re HP?
Why didn't they refer me to PC world last year?
As I'm sure I would have received a higher offer then?!
I did take out extra warranty but canceled it after about 18 months I think!
Ps I first contacted PC world June/July this year!

And no, the warranty is not included in that price, that is solely the laptop!

Hello Dodo,

It is a shame that you didn't contact PC World straight away and that HP did not advise you to do the same as the refund would indeed have been higher.

In fairness to PC World a retailer can only ever use the date the failure is reported as the actual date of failure.

If the extended warranty that you purchased is not included in their offer then you should also tell them that you want this refunding as they cannot sell an extended warranty on an inherently defective laptop. They may fuss and complain about refunding you that money, but you are entitled to it so don't let them try and fob you off.

PC world have now had my laptop for 5 weeks, they originally said that they would contact me after 2 weeks to keep me updated, but it was during the 4th week that I contacted them, and had to wait several days, as they kept e,mailing me to call them on there 0844 number, (I don't think so)
It is 5 weeks today since they took my laptop away!

So I am also less than happy with there customer services!

Five weeks is absolutely ridiculous.

Did you watch Watchdog last night?

Yet again PC World's repair centre, amusingly called the KnowHow Team, were lambasted on the program for their appalling customer service.

At one point they admitted to losing a pallet of laptops, only to quickly change this to only losing one laptop, though you have to question why they initially admitted to losing a pallet of laptops.

I wonder if yours has gone the same way?

I would now tell them that they have five business days in which to make you an offer of a resolution. I would also tell them that if they fail to make you an offer in that time then you will proceed straight to litigation without further communication with them.

I would further tell them that the Sale Of Goods Act states that any offer of a resolution should not cause undue inconvenience. I would tell them that having to wait five weeks is unduly inconvenient and wholly unnecessary.

Don't let them keep you waiting like this. Take control and give them a tight deadline in which to comply.

If they fail then sue them.

You are in the right, the retailer is in the wrong and the law is on your side.

Thank you again for all your advice,

I did the above, and on Sunday, (yes sunday) a manager rang me, as I had requested a manager call back, but still stated that the maimum they would offer is £324, so I accepted, not happily I might add, they rang today for my details, and said the money should be cleared by Friday, they also paid via bacs, where they normally pay by vouchers, or gift card.
