At last some hope. My laptop started giving grief a few weeks ago. Black screen, freezing, failing to find wireless. As it was purchased approx 4 yrs ago (£800) I presumed I would just have to put up with it. Then I found this site. Happy days.
I have run the temp tests (thanks for the tools). The results are :
94% load GPU = 93 degrees
normal load 70 ish degrees
It didnt get any higher than 93 due to the fact that the screen than blanked.
Strange thing is that I can plug in an external LCD and this functions as normal if it is running at the time that the laptop screen blanks.
I purchased this from Comet. Would it be right to assume that my first call would be to customer services or so I need to visit the store? I still have the receipt for this. Many thanks.

Hello Kris and welcome to our forum.

Sorry to hear that your laptop has failed.

Those temperatures are way to high and coupled with the black screen and loss of wireless I would say that it is highly probable that your laptop is indeed inherently defective.

I have seen many instances where the display will work eternally but not to the LCD panel.

You should now contact Comet and should tell them that your laptop has failed due to what you believe to be an inherent defect in the Nvidia GPU.

They may tell you that your laptop is out of warranty and that there is nothing that they can do. You should tell them that the warranty status is irrelevant as you have six years from the date of purchase in which to bring an action against a retailer when the goods in question are inherently defective.

They may then tell you to contact HP. You should tell them that you purchased from Comet and not from HP so it is entirely Comet's responsibility to resolve the situation.

See what they say. If they say they will inspect it for a fee you should refuse and say that due to the "reverse burden of proof" then you will provide your own independent engineers report.

If you follow my advice in that guide then you will be successful.

1st shot today. spoke to a man from comet (proceeded in the manner that Paul had forcast. I mentioned the SOGA and he offered to get a "their" people to do an examination and report. I kindly declined. The man from comet gave me the Hull address and asked me to forward the report.
He didnt seem surprised by the issue; treated it as an everyday occurance. Should I stick to the plkan and send the "letter before action ahead of any report? Cheers.

Hello Kris,

Comet are, if nothing else, predictable.

You have already been instructed to forward a report by the person whom you spoke to at Comet so that means that you do not now have to send the initial letter before action.

I would now proceed to obtain an report and subject to your laptop being inherently defective would then forward a copy of that report to Comet along with a final letter before action.

If they fail to respond positively within seven business days then I would sue them as that seems to be the only language that they understand.

received replay from comet today (they received the LBA on 10/01/12),
The letter states:
"I have been advised by our multimedia aftersales manager that it was confirmed that the nvdia defect only realtes to certain ranges on HP and Compaq models manufactured between 2006 and 2007.
Although I appreciate that your unit is showing simular symtoms there is no evidence to suggest this is a result of the nvidia issue as you (something illegible due to dody printer- who'd have thought).Therefore, any inspection or repair would be on a chargeable basis and I am unable to agree to your request for a refund or replacement.
I trust this information clarifies our position and please accept my sincere apologies for any inhis matter may have caused
yours sincerely,"

What is my next step? Engineers report or another letter? Any advice greatfully accepted. ATB.

Hello Kris,

Don't worry about the response that you have received, it is a standard fob-off and was to be expected.

Your next step is the engineers report. If it is confirmed that your laptop is indeed inherently defective then you should send the report to Comet along with a final letter before action.

If they fail to reply positively to that then you should proceed to litigation, though the chances are that the report will prompt them into action.

Please could you let me know the P/N from the white barcode label on the underside of the laptop and I will see if I can find any further information relating to your model of laptop.

Hello Kris,

Thank you for providing that information.

Your laptop contains an Nvidia Geforce 8400 GPU (GPU REV G86-730-A2) which is widely reported as being defective and is failing in huge numbers.

I note that the same version of GPU that is present in your laptop is also in the Samsung R700, which is failing in large numbers, the Sony FZ18M - which has been publicly acknowledged as being inherently defective, the HP DV9572EA, DV9655EA, DV9820EA and the list goes on.

Do you think it is pure coincidence that all the above laptops have the same version of GPU and all of them are failing due to the defect?

The important point to note however is that Sony have admitted to the defect in a laptop that contains the self same revision of GPU as that which is in yours. There can be no escaping that fact!

The evidence is there, whether Comet chose to accept it without the need for litigation is another matter.
