Just for you ref the money claim on line site differs from the info you provided (presume that they have just up dated it).

Hi Paul,

Not spoke for some time trust you are well, After registering with Moneyclaim Comet have wrote to me offering to settle!

The original laptop cost £399.00 (30/11/2007) they have offered £216.66 allowing for usage quoting (section 48C3 of the sale of goods act1979 as amended) plus fees.

I have spoken to them direct making a counter offer asking for a replacement laptop from there shop stock of the lowest priced laptop that they have as advertised on the internet of £299.00 + fees of £100.00
Stating that in light of the Nvidia inherent defect on the day I purchased the laptop is was at some point going to fail preternaturally, also I can not replace my daughters laptop for £216.66

Comet have wrote back to me stating that they have reviewed my request & they feel that their original offer is fair & reasonable.

I have the paper work from Money claim asking me to accept or not accept by the 8th February what advice would you offer?

Hello Mike,

To be brutally honest I think their offer is quite fair. Based on the information you have provided, which is a purchase date of 30/11/07, a failure date of 01/08/2010 and a purchase price of £399 I calculate that the minimum refund you should receive is £179.55.

Their offer of £216.66 is therefore higher and is fair based on the usage that you have had.

It would be unlikely that you would receive more if you were to proceed to the small claims court.

Why not try and barter them up to, say, £250 and then accept?

At least it will go a long way towards a replacement.

And please bear in mind that if you get to keep the old laptop then you can sell it on Ebay for parts to make up the difference towards a new laptop :-)

Hello Paul,

I have accepted Comet's offer & have received payment of £216.66 plus costs. It has dragged on for a while (5months) but has been well worth the hassle in the end.

If I could give anyone any advise it would be just stick with it and it will be well worth it in the long run & to follow you're advise.

My big frustration has been & is Comets really poor customer service, They have not been helpful at all only when I logged with money claim did I get any positive response from them.

Very short sighted, it would be my last choice to decided to buy any electrical item from Comet in the future!

Hi Ralph, Comet requested the return of the lap top.

I have to agree with you regarding Comet's customer service. A lot of customers, like yourself, found that the only time that Comet sat up and took notice was when you filed a small claims action.

I am glad though that you didn't have to proceed with litigation and that you managed to reach this positive resolution.
