To be honest I think you made the right decision rather than to accept a repair where Comet were unwilling to provide information that would allow us to confirm and verify their claim that the board was indeed free of the defect.

Hi, Just an update on my Case.

Comet have today issued at defence according to Money claim online (I guess I will receive this in the post)
My case has also been transferred to my local court

Will it be now that I will receive the allocation questionnaire mentioned on here?

Is it still likely at this stage that comet will settle out of court?

I will let you know what the defence is once I receive it.

Mark,

Once your local court receives the case they'll send you a copy of the defence along with an AQ.

Bear in mind that a number of courts are quite badly in arrears with their work so it may take some time.

Comet are basically just trying to put you off - it's their normal tactic if they decide they want to be difficult. At the end of the day they're still likely to attempt to settle before it goes as far as a hearing.

PS: if you go through some of the older posts on here you can probably work out what the defence will say - their work experience bod normally churns out the same rubbish :@

I can guess what Comet's defence will be. Apart from the fact that it will probably mirror all their other defences it will probably also state that you rejected their offer of a repair which was unreasonable.

Don't worry though Mark, when you do receive their defence simply post it up here and we will help you with it.

Just another update. I Received a letter last week with an offer from comet broken down below:

7/15th of the purchase price £186.62
Engineer report £65
Court Frees £35

Total £286.62

I am happy to accept this offer and have phoned comet to tell them but i am awaiting the cheque. My question now is the AQ for the court is due back this Friday the 12th. Do i wait for the cheque before cancelling the court action or can i still cancel after returning the AQ ? Or should i just cancel the court action now either though i haven't got the cheque yet ?

I have chased it up and it should be here in the next day or 2 but this will probably make the AQ late.

Reading other posts i am guessing i just send a letter to my local court explaining it has been settled and i don't want to proceed with further action ?

If the AQ is only going to be a day or two late then I wouldn't worry - most courts are still in arrears and would allow an extra couple of days anyway.

However, I would tell Comet that you'll be filing the AQ on Friday if you haven't received the cheque - it doesn't do any harm to get them working to your timetable rather than theirs. :D

No problem with that - as the claimant you can cancel the action at any time.

It is a shame that they made you proceed as far as filing your claim but hey, it only means that they had to refund you more. :D
