Success!!

As you can read earlier in this thread, I was due to send my laptop away for a report following Comet's initial response to my first letter. However, as I was about to go away on holiday, I decided to write a further letter to see if they would re-consider whilst I was away. I added the following key items in the letter, over the items in my origianl letter:

* My computer has the same mother board as those listed by HP
* The above board details have been accepted in previous cases of this defect
* Comet Plc have already agreed to replacement or refund in similar cases, which are fully documented

I am therefore, once again, providing you with this final opportunity to remedy this situation and hereby formally provide you with 7 days .......................

................ will form the basis of my Small Claims Court action. My correspondence will demonstrate to the Courts that Comet Plc had the opportunity to provide appropriate resolution to this matter, but have acted unreasonably and unprofessionally (if they continue with their current stance), especially as Comet Plc have settled similar claims for the exact same machine just prior to the Court hearing date. I will also be claiming all reasonable related costs to this matter.


So, whilst I was relaxing by the pool in Egypt last week, I received a call from Comet (Hull) to say that they had re-assessed the case with their Engineer's and offered to provide an exchange for the full amount paid!

I returned my 'faulty' laptop this afternoon and collected a new HP G61 model ..... with a intel dual celeron processor (thanks for the advice Paul). I paid the £50 difference. Now writing this note on my new laptop...... with the wireless working!!

Many thanks to everyone on this forum and especially Paul, without whom I would be still sitting here either with my old laptop (without wireless working and getting hotter by the day); or a replacement paid wholly by me!

Please follow the advice on this forum and stand firm! Do not give up ..... you may get a result sooner than you think!

Hi Mel. I am in a similar situation to yourself in that i have received a phone call from comet explaining that the laptop isn't one of the models listed by HP. I was about to get an engineer's report until i read your post. Could you possibly pm me the full copy of the 2nd letter you sent or if i pm you my email address could you email it over?

This is the BIOS update for your laptop and the purpose of this update is:-

Quote:
Updates the fan control algorithm of the system to reduce the likelihood of future system issues.


This update, listed as "CRITICAL" was released on the 14th December 2007.

I note that you purchased in December of 2007. Why didn't HP inform you of the potential for the premature failure of your laptop?

Why did HP deny there is a problem with your model of laptop when this BIOS update proves so succinctly that there is? Otherwise why did HP release a BIOS update for your laptop that switches the fans on 24/7 to the detriment of the battery?

Just thought that this may help you.
