Hi, my girlfriends laptop has recently died. After looking through many websites and this forum it appears that this is due to the nvidea graphics card problem. The laptop has always to my mind run hot despite attempts to keep it cool. Finally the screen is now black even though you can hear the laptop itself boot fine etc. Ive tried it on an external monitor and get nothing at all.

Really I need advice on what to do next, the laptop was purchased from PC World 11/04/08 using a debit card. Although she doesnt have the receipt she took out something called called PC performance (now expired) but which shows the purchase date etc from PC world.

The p/n on the white label is KW300EA#ABU.

Is this likely to be eligible due to the nvidea problem and if so should I just follow the steps outlined in the sticky in this section?

Hello Gareth and welcome to our forum

I have inspected a number of your model of laptop and they were all found to be inherently defective.

Your laptop contains an Nvidia 8400 GPU which is one of the more prolific of the defective GPU's so I would say it is highly likely that your laptop is indeed inherently defective,

You should contact PC World and should tell them that your laptop has failed due to what you believe to be an inherent defect with the Nvidia GPU.

They may tell you that your laptop is out of warranty and that there is nothing that they can do. You should tell them that the warranty status is irrelevant as you have six years from the date of purchase in which to bring an action against a retailer when the goods in question are inherently defective.

They may then tell you to contact HP. You should tell them that you purchased from PC World and not from HP so it is entirely PC Worlds responsibility to resolve the situation.

Thanks for the reply. Ok have spoken to them on the phone and though they didnt mention the warranty date they did insist I would have to contact HP. I stuck to my guns and they got a supervisor on who told me to write to head office and also cc it to KnowHow PO BOX 1686 - which is currys coverplan team.

Edited your template letter from head office so will get that sent off later.

Thanks for the help so far - i should imagine the engineers report will be next step

Ok, we've had a response from PC world which asks for the laptop to be returned to them at a cost of £50 (which graciously includes shipping) for them to test it. if its found to have a hardware defect it will then be repaired. Theres no mention of what happens if they dont find a hardware fault but will refund the £50 if there is one.

Not sure how to proceeed as what are the chances of them admitting to a fault even if they find one?

I would refuse their offer and would tell them that the Sale Of Goods Act states that there is a reverse burden of proof which means that the onus is on the customer to prove to the retailer that the laptop in question is inherently defective and that you wish to provide your own engineers report.

Hello Gareth,

Well their response to date has been that you send it in to them at a cost of £50 for them to inspect. Had they followed the Sale Of Goods Act they would know that they should have asked you to provide proof that your laptop is inherently defective by way of an engineers report.

This is what is known as the reverse burden of proof and comes into effect six months after the date you purchased the laptop.

This basically means it is up to you the customer to prove to PC World that your laptop is inherently defective. It is not for them to prove this on your behalf.

I would advise that you now proceed with an engineers report and once you have that send them a copy along with a final letter before action.

If they fail to capitulate then you should move onto the next step in the step by step guide.

Hi, having sent the report off ive had a letter back asking to contact them which ive done - and theyre offering £280 of PC world vouchers. At this point I feel for the age of the laptop thats reasonable - its just a shame theyre vouchers for pc world group I suppose.

Is it worth holding out for more or should I just accept do you think.

Many thanks for the engineers report Im sure its whats pushed them to this point!
