Thanks Paul. It does sound odd that they'd rather have internet printouts (I did say that mine wasn't on HP's list of problem laptops, and he suggested any other information about it would do, as long as it specifies my model) that say other laptops have failed because of this fault, rather than a report showing that mine itself has.
I'd be happy with a repair with that guarantee but would prefer a replacement/refund, rather than have to go through this palava a year down the line again!
Do you know what rights I have to claim back the cost of the report if I did go ahead and have it done? I am tempted to get the head office address and send off the relevant info/forms to prove my laptop is faulty, rather than apply for a repair out of warranty and wait and see what they say - I wouldn't want to send my laptop off for repair without this engineer report, only for them to try to worm out of me not paying by saying it was a different problem.

Hi Paul, just wondered if you'd had a chance to draft up that letter? The form came through from Tesco and as it requires proof of purchase to be sent along with it, I'd like to include such a letter so they don't delay things when they see that it was purchased under a different name (and gender :lol: ) to mine. Thanks

After resending my form I got a letter back from a Melanie Watts at Tesco, offering me £241. Considering the later states that they give a full refund within 12 months, and my laptop only lasted 14 months, I'm not sure how they work out 2 months of use to cost me £200! The letter even says they wouldn't expect a laptop to only last 14 months, so don't quite get the logic there.
Obviously going to write back to state I'm not happy with what I've been offered, assume from letters from from Tesco Direct that I may not get very far doing this, so may be in touch with you soon for an engineer's report Paul, so I can go down the small claims route.

I agree that their logic is illogical.

£200 for two months extra use is ridiculous - how can they possibly justify that?

Ms Melanie Watts really must try harder when it comes to doing her sums - maybe she was having an off day?

I have drafted up this response, unsure whether to 'threaten' small claims court yet or allow one last chance of a sensible offer - though from the other Tesco threads, not sure I'll have much success there.

Dear Melanie,

Thank you for your response to my form. I appreciate you taking the time to acknowledge my faulty laptop. However, I have good reason to believe that I was sold an inherently defective laptop containing a fault nVidia chip, as I have been made aware that this issue is happening in a lot of HP and other laptops containing nVidia chips. I do believe you have recently received letters from customers complaining of the same issue. This defective chip is well documented, not only could you view the many articles I sent a list of in my previous communication, but by simply searching Google for "nVidia defect" you will get numerous hits that show this defect is not just limited to the models HP have issued an extended warranty to.

I decided to purchase my laptop from Tesco Direct due to the company being a 'big name' company, believing I would get good customer service, both at time of purchase and down the line should any issues arrive. Therefore it disappoints me to hear that you are not acknowledging this nVidia defect or the fact that these laptops were defective at time of purchase, thus falling short of the Sale of Goods act (product to be both fit for purpose and free of minor defects) which allows the consumer 6 years to make a claim, aside from the 12 month warranty. Considering another large retailer, Staples, have acknowledged this defect and taken suitable action to compensate its customers, I am disappointed that Tesco are not following suit.

As you stated in your response yourself, it is not satisfactory for a laptop to last only 14 months and I am disappointed that you believe two months use outside the warranty deserves a refund of only half the purchase price - would a customer buy a laptop for £241 and be expected to be happy with 2 months use? I would struggle to get anything more than a Netbook with a budget of £241, let alone a laptop of the same quality as my HP laptop.

If I do not receive a satisfactory resolution to this matter then I will have no alternative but to take action through the Small Claims Courts. I am therefore giving you this last opportunity to remedy this situation.

I am formally giving you 7 days from the date of this letter to refund the full purchase price of the laptop. If you do not respond in the positive within this time then I will have no alternative but to obtain an engineers report, the costs of which will be claimed from yourselves.
I will then use that report, along with the myriad articles of information that areavailable to pursue this matter through the legal system.

Tesco really aren't willing to budge on this one are they? Latest response, not even a "If you're happy to prove us wrong, go ahead", just a "It worked so it's not faulty" (surely by now at least one member of staff must've Googled this problem to see just how it works?)

If not, then that should be your next step.
