Good evening folks.

I bought a HP dv9655ea part number KB398EA#K7 from Comet 9 Dec 2007 as a Christmas Present for my wife and much to her dismay the graphics chip has failed last week. Lots of green pixels on the screen then a blank screen on start up. Doom and gloom I thought until I found this web site. I am going to visit Comet at Fareham tomorrow or Monday morning to see if I can resolve the situation and outline the six year rule. Reading through this forum there appears to be many similar cases in relation to graphics failure regarding this particular model. I am peeved because I have just bought a replacement laptop from Currys but this time a DELL.

I can see my dealings with Comet is going to be a bumpy ride but feel that I have the support of this web site all the way through to the end.

Hello Frank and welcome to our forum.

Sorry to hear that your laptop has failed.

From the description of the problems that you have given and because your laptop contains an Nvidia Geforce 8400 GPU (GPU REV G86-730-A2), which is one of the more prolific of the defective GPU's, thenI would say that it is highly likely that your laptop is indeed inherently defective.

Good luck for when you contact Comet. Remember, don't let them fob you off with any baloney like contacting the manufacturer. Be persistent, stick to your guns and you will be successful.

Like you correctly stated, we will help you all the way to a resolution.

Sunday today so armed with the information gleaned from this great web site I popped into Comet Southampton Road Park Gate Fareham. I had the defective lap top with me and all the original receipts. A friendly young sales rep asked if he could help me and I said indeed he can. His face dropped when I requested for a refund or replacement lap top. The sales rep said the warranty has expired and there is nothing he can do. He then went to get the store manager who said the same. I then explained the rational behind the defective Nvidia graphics chip and the global concern by many other similar lap top owners. He asked me for the receipt and said he cannot give me a replacement or refund. The store manager then said that I should leave the lap top with them for their engineers to look at the problem but I would have to pay for the service. The engineers may repair the lap top at my cost or theirs if it is found to be comets fault. I then advised that I wish to secure an independant engineers survey for piece of mind and it was up to me to secure such a survey and report. I advised that a full refund or replacement laptop was required. I felt that I was not getting anywhere and left Comet with my laptop and all receipts. At no time did the Comet store manager take notes or enquire who I was. I had a feeling that he knew the law in relation to defective goods and possibly the six year ruling.

My next move is to write a letter, a letter printed off this web site "Letter before Action" and send the same to Mr Bob Drake, Managing Director Comet Group PLC , Rickmansworth, Hertfordshire, sent recorded delivery first thing Monday morning. I shall also send the same by e-mail if I can secure his e-mail address.

I am feeling more confident as time goes on and now know the way ahead thanks to this web site. I am more than willing to pay for the independant engineers report and feel that the next stage will happen after the seven days deadline given in the letter has expired for Comet to come up with the refund or suitable replacement.

I had to laugh when I read that. He probably thought "oh no, not another" or "bang goes my sales commission."

I can understand the sales rep saying that and could put it down to bad training. But the store manager? He really should know better and should know the Sales Of Goods Act like the back of his hand.

When there is an inherent defect in a product then the customer has six years in which to take action against a retailer. If they don't know that then they need a refresher course.

Still, things are going to script and I have seen this literally hundreds of times in the past.

Excellent news Frank. Keep that confidence going. I know I have said it many times in the past in this forum but the key to success is persistence. Don't give up, don't let them fob you off, stick to your guns and you will be successful if your laptop is indeed inherently defective.

Cheers Paul, letter now formulated and will send it to Bob Darke Managing Director COMET Rickmansworth by recorded delivery tommorrow morning. I have also sent the MD an e-mail with a copy of the letter attached, requested e-mail electronic delivery and receipt. Seven days from the date of the letter being the 9th September 2011 has been tendered for a full refund or replacement, if no joy after seven days then that is when I shall initiate the independent engineers inspection and report via your recommendation. I have also made up a hard copy file of all the documents from purchase receipts and communications made to Comet ready just in case it has to go to court.

Hello Frank,

Ii wouldn't hold out too much hope for a full refund as you will probably only receive a pro-rated refund.

Based on the information you have provided in your profile I have calculated that the minimum refund that you would be entitled to is £244.44.

This is based on 45 months usage and 22 months none usage bringing you to the 72 months afforded under the Sale Of Goods Act.

Whether that is a good result or whether it would be best to accept a repair is entirely up to you but I have to say that £244 will not go far when purchasing a laptop.

I reckon the acceptance of repair would be agreeable, at least the laptop would be working. The repair would have to include a non Nvidia component or a new type of GPU with no inherent fault.

I shall wait to see what happens and take it from there.

A swift e-mail reply from the Comet Managing Directors office confirming e-mail reciept this morning following my e-mail and attached 'Letter before action'. Hard copy sent recorded delivery this morning with an assurrance of delivery of letter by 1300 tommorrow.
