Hello dcp1987 and welcome to our forum

Sorry to hear that your laptop has failed.

I am not sure of the laws in Portugal and so I am going to have to advise that you seek some free legal advice in your country to see what options are available to you.

I did find this site:- http://www.consumidor.pt/ which is the Portuguese Consumers website, for some reason my Google translation program will not translate the site so I am unable to provide you a direct link to the relevant section.

You need to check what options are available to you when the goods in question are inherently defective.

Regarding the Son laptop; that model has been recognised by Sony as being inherently defective so it is possible that it will fail at some point in the future.

However, until such time as it does fail or at least start to display manifestations of the defect then there is not a lot you can do as there is no evidence, at this stage, of any problem with that laptop.

Did you have to pay Sony any money for the LCD repair?

I am sorry I cannot give you more precise information regarding the laws in your country.

Any questions please let me know.

Best wishes

Paul

I already checked that site and i think i found something but still it leaves me thinking...

These are the most important lines of the law!

The things that leave me thinking are in bold!

Quote:
Article 1. º-B
Definitions
In applying the provisions of this decree
Law, the following definitions apply:
a) 'consumer', whom goods are supplied,
services rendered or transmit any rights intended

Law No. 24/96 of July 31;
b) "Consumer goods" means any movable or immovable property
body, including second-hand goods;
c) "Vendor" means any person or entity
that, under a contract, sells consumer goods in
part of its business;

not correspond to the conditions listed in the declaration

conditions listed in the guarantee statement or in

with the contract.

a) Do not be conformed to the description of them is

can reasonably expect, given the nature of good
and any public statements about their characteristics
concrete made by the seller, the producer
or his representative, particularly in advertising
or labeling.
3 - There shall be no lack of conformity in
purposes of this Article if, at the moment is
concluded the contract, the consumer is aware
this lack of compliance or not reasonably
ignore it or if the course materials provided by
consumer.
4 - The lack of conformity resulting from incorrect installation
consumer goods is equated with a lack of compliance
well, when the facility is part of the contract
for sale and has been carried out by the seller,
or under his responsibility, or when the product, which
expected to be installed by the consumer, is installed
by the consumer and bad installation is due to inaccuracies
existing in the installation instructions.

Quote:
Article 3. º
Supply of goods
1 - The seller is liable to the consumer for
any lack of conformity which exists at the moment
where the goods were delivered.
2 - The lack of conformity which becomes apparent in
within two years or five years from the date of delivery
of corporeal movable or immovable object, respectively,
assumed to be already existing on that date, unless
this is incompatible with the nature of the thing or the
characteristics of non-compliance.

What is not clear to me is when it talks about the years that the lack of conformity appears! i don't know if it limits 2 years or not because of the way its written! because im my case it already passed those two years! :s

Hello Dcp1987

I really think that you need to seek some free legal advice in your country.

In the UK the Sale Of Goods Act is fairly straight forward and gives a good deal of protection. I am not a lawyer and so am unable to disseminate the information that you have quoted above.

I am really sorry that I cannot give you more definitive advise and hope that the link I provided gives you some help/hope.

Please keep us updated on your progress.

Good luck and best wishes

Paul
