Hi,

Last week i decided to take out my old hp 6735s from the back of the cupboard and have another go at trying to fix it, i stumbled across this site, and the Step By Step Guide To A Refund Or Replacement Laptop http://www.nvidiadefect.com/post13.html#p13 and sent off a email to ebuyer straight away.

i got a message back saying

Dear John Crisp,

Thank you for your response.

I apologise for the delay in responding to your enote.

In terms of the Supply of Goods to Consumers Regulations, goods must be as
described, fit for purpose and of satisfactory quality i.e. not inherently
faulty at the time of sale.

The onus however is on the purchaser to prove the goods did not conform to
contract (e.g. was inherently faulty) and should have reasonably lasted
until this point in time.

In terms of the above we would require a fault report from an independent
company/technician that shows that the item has been tested and that there
is an inherent or manufacturing fault present with the item in order for
us
to take the item back outside of warranty. Please look around for a fault
report as we would only refund up to £25 towards the cost of the report
once confirmed with the testing body that the fault is as mentioned
inherent or a manufacturing fault.

If you are able to obtain this proof please email the fault report to
rma.approvals@ebuyer.com quoting your order number.

Hello John and welcome to our forum.

No you haven't missed out anything and it is all going to plan.

Having dealt with Ebuyer on numerous occasions, whilst their policy on the amount that they will refund towards the report leaves a lot to be desired, once they have the report they will move pretty swiftly.

I am actually out of the country for three days starting Monday the 7th March and I will be back late Wednesday 10th March so if you book your job in I will not be able to arrange collection until Thursday of next week.

I apologise in advance for this delay.

If you do have any questions then please feel free to post and I will reply on my return on Wednesday.

Sorry for not replying recently, been busy.
but been sorting out trying to get ebuyer to pay me my moneys...

sent the report off like i was asked by the Ebuyer Customer Support Team to the email they gave me and got this response

so i got back saying it is the retailers responsible, and im really fed up now so i have gave them till midday tomorrow to offer a full refund or i will start the small claims, because i have noticed that they only reply before 12pm, what is a bit odd.

will post tomorrow with there reply.

I cannot understand why they have referred this to HP when they have refunded numerous customers with the same model.

Which was the reason I contacted you in the first place
I am sure I do not have to remind you of your obligations under Sale of
Goods Act 1979(as amended). As the laptop has failed due to an inherent
defect, it is not of satisfactory quality nor is it durable and so you are
in breach of contract,

I have gave you more then enough time to reply back with a satisfactory
offer, and you keep saying your in contact with the manufacturer, and you
will get back to me, but you the retailer sold me the laptop, so it it your
responsible,

I have started proceedings with the small claims court, just i havent had
time to file the paper work, as i have been very busy with work, i was
giving you the benefit of the doubt that you would reply with a
satisfactory offer, and got this sorted a lot earlier.

there is over 10 case's i have read about where you the retailer have
refunded the full amount back to the customers, with the same laptop as
mine, and for the same reason, and in some of the cases recently thay have
had to take you to court just to get it sorted,

this is the last time i hope you reply back with a satisfactory
offer!


Not fun, i would have filed the small claims by now, but so busy at work, and tired on the weekends that just havnt got round to it,( i have also started have a go at them on facebook.. at lest it makes me feel alil better)

Hello John,

I wonder why it is taking HP so long to come back with an answer?

Like you correctly pointed out, HP are the agents of Ebuyer and so it is of no concern to you that they are prevaricating over responding to your claim.

How long can they expect you to keep waiting?

I would give them a short window of opportunity to make you an offer and if they fail then I would proceed with the next step in the step by step guide.

The length of time you have been waiting is unacceptable.

Very intresting read.

I will update my own thread later however I have been getting the run around from ebuyer recently, denying they received a few emails I sent until I sent the audit trail of them to the exact same email address.

Ive also contacted HP's managing directors office again after Pauls engineers reprt and they continue deny that this model has an inherent fault. Please anyone who has this model with an issue email HP so they investigate this model, They have called me the following day both times ive emailed.

HP told me they didnt deal with Ebuyer direct but through a business partner who distributes.

HP actually deny that there is an inherent defect in your model of laptop?

There is an old saying about putting your brain into gear before putting your mouth into action and HP could certainly benefit from that.

There certainly is a problem with your model of laptop and it beggars belief that both Ebuyer and HP are playing games with you.

Don't let them drag this on for much longer. I would now give them a tight seven day deadline in which to make you an acceptable offer of a resolution. I would also tell them that time is of the essence and that if after seven days they fail to make you an offer then you will proceed to litigation without further communication with them.

If they fail to do so then you should pop on over to www.moneyclaim.gov.uk and should file your claim.

Don't waste your time with HP, you have no contract with them. Concentrate on Ebuyer and remember, HP are acting on behalf of Ebuyer and not you so it is irrelevant what HP state.

Furthermore, a recent survey by Square Trade stated that HP laptops have a failure rate of 25.6%

How bad is that.

That is roughly one in four laptops that will fail prematurely.

Which is precisely why I would only ever purchase Toshiba laptops, which only have a 15.7% failure rate.

I have followed the step by step instructions on this site in pursuing Ebuyer. The Recorded Delivery letter before action was sent 28/6/11 and I have not had any response or acknowledgement.

Have you check with the Royal Mail website to see if the letter has actually been delivered?

If it has then you should give them a quick call to see if they are prepared to make an offer of a resolution there and then.

They will probably then tell you that you need to provide an engineers report in order to confirm your beliefs.

If they do then please let me know as this is a service we provide.
