Hi Paul

Thanks for your reply, I'm waiting for Currys to put the offer in writing before I proceed, but have preliminary told them I will be turning down the £275.00.

I notice your sums are different to mine, and I cant see why.

Could you show me your workings, details as follows.

Laptop price - £499.00
Purchase date - 26/12/07
Date fault reported to Currys - 12/08/10

Can you show me over the 5 yrs and the 7 yrs.

Cheers

Hello Dazzer,

The way to calculate your refund would be as follows:-

5 year rule

£499 /60 = £8.32 per month
60 months potential usage less 32 months actual usage = 28 months unused usage.
£8.32 * 28 = £232.87

7 year rule

£499 / 84 = £5.94
84 months potential usage less 32 months actual usage = 52 months unused usage
£5.94 * 51 = £308.90

The original figures I quoted were incorrect as I had based them on a failure date of July 2010 instead of August 2010. I have amended my original post.

I hope the above helps.

Any questions please let me know.

Best wishes

Paul

Hi Paul

Today I recieved the letter confirming the refund from Currys, amazingly it has reduced from £275 to £240 inc the cost of the report.
I have rung them and explained this which the claim to be an innocent error. I have gone through the figures that I believe correct for the refund, and they now state that the value per month for the life of the laptop reduces, hence why they have a refund over 5yrs of around £190 compared to our £232, I explained this to be rubbish and also explained my rights to claim up to £200 for the report, I have only asked for the £65.

The are adamant they will not budge from the £275, even tho I have oly asked for £297.87 inc the cost of the report!

I have asked them to send a new offer of refund in writing to the value of £275.00 and as soon as recieved I will start legal proceedings for the £22.87. Can you believe they are being so petty!!!!

Is it worth just accepting the loss of the £22 ? Or will the court see things in my favour do you think.

Truly Currys are a comical company. And anyone dealing with a customer Service advisor named Jay should ask to be passed on to another person, the guy is an outright liar.

Regards

To be honest I would accept their offer and then vow to never step foot in one of their stores again. You should also vow to tell family and friends of the treatment you have had so that they too never purchase from them again.

It really is not worth proceeding to court for the sake of £22 and the judge could rule that you had acted unreasonably by proceeding to litigation when a refund offer was on the table.

I think comical is an understatement. I think that the whole of the DSG Retail company (who own Currys) are shambolic to say the least and are, in my opinion, thoroughly unprofessional.

The only time I would ever step foot into one of their stores would be to shelter from the rain.

Good luck and best wishes

Paul
