Hi, i have dell xps1530 which have the gpu problem. It show colored lines on bootup and stuck there. My laptop is 2.5 year old out of warranty. After reading post nvidiadefect.com I called Dell, they told me its a motherboard issue and it need to be replaced. I told them the all the symptoms are of gpu failure the support executive confirms this problem but they insist of warranty extension. Then they transferred my call to manager and finally offered me $300 for 2 years warranty extension but i still insist and told them i will file a case. They told me they will escalate my case and there legal ept will call me 2 days. Now am confused whether to proceed to legal action or take this discount. I am from India. Please reply.

Hello Danegt and welcome to our forum.

Sorry to hear that your laptop has failed.

Take absolutely no notice of Dell, why on earth should you have to pay them a penny towards your inherently defective laptop?

Your model of laptop has already been acknowledged as being inherently defective and that can be found here:- http://nvidiasettlement.com/pdfs/NVF_NOT.pdf

So, with the above in mind it is Dell who should be paying you, not the other way round.

They have been paid millions of $'s in compensation from Nvidia with regard to this problem so it is time for them to get their cheque book out and to start to spend some of the compensation they have received.

Are you able to sue HP in your country?

I am sorry, but I am unsure as to the laws in India.

Under no circumstances should you pay them a single penny (or should that be rupee)?

Lapcure, Lapcure, thanx for d quick reply. In India we have sales of goods act 1930(British). I dont know about hp but people have used it against dell for other reason. I have payed money through draft. Pls tell me whether i would be eligible for claim ??

Hello Danegt,

I took a quick look at the Sale Of Goods Act 1930 that you refer to but it does not appear as helpful as The Sale Of Goods Act 1979 (as amended).

The fact that your laptop contains an Nvidia 8400 GPU which is one of the more prolific of the defective GPU's then I would say that it is highly likely that your laptop is inherently defective.

So, couple that with the information available in the Nvidiasettlement link that I quoted previously, then I would say you have a very goods chance of a success against Dell.

Are you able to get any free legal advice in your country?

I am sorry I cannot advise you with regard to the legal process in your country.
