Hi there,

I am new to the forum and have a similar problem with my Pavillion dv200 as Khas. Initially the screen would go down in the same way but now I can get nothing on the screen.

Have tried using a VGA cable to connect it to a monitor but no success.

I am in the UK and got it from PC World in June 2008. However I (foolishly) took out a sole trader business rental with Rentsmart. I naively assumed that they would repair if anything went wrong but how wrong was I. Their business model is basically to wash there hands of customers in these situations and refer them back to PC World. Even though I only have 5 months left on my contract with them!

I have tried to contact PC World but they refer me to the store I purchased from and getting hold of the store is a near impossibilty.

Before I go to the store for what I expect to be a battle, I was hoping to get some advice on what I can do? I am a sole trade as stated and am totally dependent on my Laptop, as it has all my files etc.

Can you help please?

Many thanks

Chuck

Hello Chuck and welcome to our forum.

Sorry to hear that your laptop has failed.

Please can you let me know the P/N number of the laptop which is on the white barcode label on the underside of the laptop and I will see if I can find out any further information.

The problem is, if you purchased as a business then you are not covered under the Sale Of Goods Act and so cannot make a claim citing breach of that.

However, you could bring a claim for damages due to the fact that you have been sold an inherently defective laptop. I am not a lawyer so I would advise that you seek some legal advice on that basis.

If you have five months left on your rental then they cannot refuse to resolve the issue as they are under contract to you.

So, whilst you cannot make a claim under the Sale Of Goods Act there is still avenues open for you.

I would start off with the fact that they have to repair it as it is still under a rental contract but you want some form of a guarantee that the repair will be undertaken with parts that are free from the defect.

What do you think?

Please let me know the P/N and I will advise further.

Best wishes

Paul

Hi Paul,

Many thanks for coming back to me.

The p/n no. is KH920EA#ABU.

Have so far only discussed this issue with Rentsmart (the leasing company), since as they are the people taking my money every month I felt it was their responsibility. They say I should have had a warranty which apparently should have been offered at the time, although they have admitted by email that there was no funding option for this at the time to add it to the rental. I took insurance which, since it was 50% of the rental cost (added on top of the rental) I presumed would protect me fully, but it seems that I will only get any payout if I arrange to destroy my computer and tell them it was an accident!

Rentsmart have said that without a warranty it is my responsibility to meet the repair, even though I am still duty bound to pay them every month :-) On top of that I have to give it back in working order in 5 months! Talk about having your cake and eating it!

I will try to find out my legal rights as suggested, and then go to see PC World to see what they will do. Since I am not made of money do you think CAB or do youb have any other suggestions please?

What I don't get is that this is clearly (at the very least) a highly unethical way of conducting business. At some point PC World and Rentsmart willl have known they were procurring defective goods but made no contact to warn customers. You would think they would both want repeat business?

I also saw that HP did some recalls and that my Laptop was one of the model types. Is there any mileage in this do you know? Tried verifying my computer on their site for a recall but I dont seem to have the required barcode number begining CT on my laptop.

As an aside, after awful customer service from robots at Rentsmart I phoned the Managing Director. The coward would not get back to me over a 3 day span....if/when I get fobbed by PC World I will pursue the same route with them. MD, Sales Directors UK and US. If nothing just to get my own back a little!

Many thanks

Spencer
