hi paul thanks for your response will try that and let you know how i get on, as i said ive been in contact with them already so i will try and bluff him some way to get it. do you know if my model was one of the affected models?

Hi Paul
Got great news,I got that receipt. I rang a different branch of soundstore and explained that I needed a copy of the invoice for insurance purposes and they gave it to me with no problem. Do you know if my model was one of the affected models? because the manager of store said that the laptops bought at the time i bought mine were not affected.

Hello Corkman,

That is excellent news, really gad that you managed to get a copy of the invoice as you can now proceed with your claim.

Your laptop contains an Nvidia 7000 GPU. Whilst your laptop is not on HP's list, that does not mean that it cannot possibly be inherently defective.

There are a number of laptops that are not on HP's list that are failing with the defect so it is no surprise that your laptop is not on the list.

I wouldn't let them fob you off with that one.

If you follow my advice in the step by step guide which is here:- post13.html#p13 then you will reach a positive resolution.

hi paul have been onto the retailer again and he has givin me no help at all, i asked him for his head office address and he said that they have no head office that if i wanted to write a letter mail it to him personely, i also told him i am goin to get a computer technicians report and he asked was i bringin the technician to court and went onto to tell me that i would have to bring the technician to court with me.... have spoken to citizens advice and they told me that is not true all i need is the report, so my question is will i still write him the letters even though ive been speakin to him twice and hes given me no help or will i just proceed with gettin the technicians report and goin to small claims?

Hello Corkman,

You have now told them that you will be obtaining an engineers report and he has stated that you should forward it to him.

You should therefore now obtain a report.

Once you have the report you should send it to the store along with a letter before action. This gives them seven days in which to respond. If they fail to do so then you should file a Small Claims Action against them.

If your laptop is indeed inherently defective then you really cannot lose.

If you would like us to provide you with a report then please let me know.

Remember, it took a long time to earn the £550 to pay for your laptop and it would be a real shame to simply write that money off.

Hi Paul,

Have had some movement out of Staples Head Office, who recognise there is a defective component in laptops with the Nvidia GPU.

They have forwarded me the below email and requested an engineers report. In an earlier post you mentioned that if a report was needed I should make contact as this is a service you could help with.

'Dear Russell,

Thank you for your email

As discussed the following email outlines our procedure for out of warranty claims. Under Consumer law, the retailer has the right to have any goods inspected to check whether the problem is caused by an inherent fault in the machine or if the fault was caused by customer misuse. It is Staples policy to request an independent assessment from the consumer under the reverse burden of proof section of the Sales of goods act, for items over 6 months old. Said report would be refundable in the event of proven inherent fault.

An inherent fault would be one which was present at the time of purchase. Examples are:

• An error in design so that a product is manufactured incorrectly • An error in manufacturing where a faulty component was inserted.

We are happy for you to use an independent assessor. We do however require them to be VAT registered and must be able to provide the following-

1, The report must name your machines make and serial number, 2, State the nature of the fault and the reason for this, 3, A breakdown of possible repair costs 4, Must be suitable for litigation purposes if required.

If the goods are considered to be un-repairable or not economically repairable, then we will take steps to resolve the issue, subject to a valid receipt. This practice is approved by Consumer Direct which is a service from the Office of Fair Trading.'

Well, that is great news as it means that you are now moving forward.

The cost of the report is £65 which includes the collect and return carriage. This amount is fully recoverable from Staples as a consequential loss.
