Hello 1gdsmawd and welcome to our forum.

Sorry to hear of the problems you have experienced with your laptop.

Have you contacted the retailer yet regarding the failure? If your laptop is indeed inherently defective then you will be able to take legal action should the retailer fail to comply with their obligations.

Have you taken any legal advice in your country?

Here in the UK we rely on the Sale Of Goods Act, is there a similar law in your state?

Did you pay by credit card?

Please let me know and I will see if I can help.

Best wishes

Paul

i got the laptop as a gift since i was going to school 1500 miles away. it was purchsed on a credit card i have contacted hp and they have pretty much told me to take a long walk off a short pier or give them 450 dollars to fix it. i came on here to see what the best way to approach this would be i have not taken legal action yet as i am thinking of contacting the attorney general

Hello 1gdsmawd

Pardon my ignorance but I am unsure of the laws in your country. Are you able to pursue the credit card company for this? In the UK the credit card company is jointly and severally liable along with the retailer in situations such as this.

I think that it is scandalous that HP should try and charge you $450 to repair a laptop that they must know is inherently defective.

There is a crime called fraudulent concealment. The legal definition for this is :-

Quote:
Deliberate hiding, non-disclosure, or suppression of a material fact or circumstance (which one is legally or morally bound to reveal) with intent to deceive or defraud in a contractual arrangement.

I wonder if HP's attempts to charge to repair a laptop they must know is inherently defective would constitute as fraudulent concealment? I am not a lawyer so it could be worth asking the question.

I wish you good luck in your quest, please keep us updated on your progress.

Good luck and best wishes

Paul
