Hello Djkprokects,

How typical of Laskys is that?

I bet they have just Googled that information and would wager that if questioned as to any aspect of the sale of goods act then they wouldn't have a clue!

I wouldn't worry in the slightest and would press on with the next step.

Like you correctly said, the next step is an engineers report. We can help you with that and have had great success when our reports have been presented either to the retailer or when used as evidence in court.

For more information on how to obtain a report please see here:- need-an-independant-engineers-report-t62.html

If you have any questions or if you need any advice then please let me know.

Good luck and best wishes

Hi Paul,

Thanks for the advise on the report - most likely that i will go for that. I've just sent them an email explaining how wrong they are  and asked what they want to do next. I said that i can accept a partial refund as long as it's reasonable or a replacement as long as it's not one of the faulty models so we'll see.

BTW - how long would it take you Paul to collect, prepare and return the laptop? Just curious.

I can imagine what their reply will be when i present your report :@ that they don't accept your reports or something similar :P

It's funny when they say that the reasonable period passed - for god's sake this is an electronic device and it should works for years - not just 36 months :) It's not a pair of shoes :P But nevermind - that's laskys' opinion and they're always right

Take care

It takes five business days in total from collection to return so I hope this is ok for you.

Well they did originally try saying they were not accepting my reports; that is until the county court summonses started to drop through their door and they seemed to change their minds.

I did laugh when I read the "reasonable period" bit. When will these guys get it into their heads that he period of time that a customer has to take action is SIX YEARS. The fact that the length of time it takes for the defect to manifest itself can be 14 months or more so how were you to know and more importantly how could you have brought this to their attention before you know of its existence?

The beauty of this forum is that their ineptness is on display for all to see.

Best wishes

<rant>This is the thing that really winds me up about Comet :x

Whilst the other major retailers seem to have settled with systems of clering up these cases fairly quickly Comet still force their customers to take them to court before settling.

They didn't "win" the vote for worst retailer on this forum for nothing and they clearly don't give a damn about the fact that they won it. All they're worried about is holding on to as much of your money as possible for as long as possible.

They know full well that a certain percentage of people will give up each time they get told "no" so they have probably calculated that it works out cheaper for them to pay the extra for court & report fees for those that stay the distance.

What is perfectly clear is that they don't care about their customers once they've got as much money as possible out of them - I can't believe that they're still trying to get customers to pay more money to them to inspect the laptop. I bet it would just come back as "mainboard failure" with no mention of the GPU whatsoever. :x :x :x </rant>

I couldn't agree with your more!

Comet are, in my opinion, a shambollic company who constantly and consistently attempt to fob their customers off. They have never won a small claims action relating to this problem yet still they continue to try and defend the actions when they know full well that their position is indefensible.

I guess the law of averages works for them, which is how many customers you can fob off and who give up compared to the number of customers who will not be fobbed off.

Thankfully, due to this site, more and more are refusing to be fobbed off.

I hope Comet have ordered plenty of cheque books from the bank because they are going to need them.

Best wishes
