I've called HP and spoke to a Case Manager again and they again tried to redirect me to NVIDIA about the settlement. Should I try contacting Nvidia? Or should I go forth and file the motions for a small claim?

Hello Shade,

Take absolutely no notice of HP when they tell you to contact Nvidia.

Nvidia were not the ones who made your laptop nor were they the ones who sold you the laptop.

HP are solely responsible and it is them whom you should pursue.

I would file a small claims action against them as they are obviously not going to comply without.

What do you think?

Yeah, I've done some more reading and it seems filing a small claims is my only option. I'll be doing so this weekend. I've read about someone on a different forum who filed a small claims and settled for 75%. To your knowledge, has anyone you know of who sued/settled with HP directly, received more or 100%? I've read some posts here of people who received a full from a retailer but not through filing a small claims to HP directly.

I'm anticipating a week before the case, that I'll receive a call from Francesca Rude and I'll maybe get 75% out of her. Which leads me to wonder when she refuses to go any further, in court would I fair better to receive more. Sorry for going too far in advance, just trying to think a little ahead.

I've paid 1100 for the laptop and the entry level Macs are about $999 so I'm just trying to get enough to get one.

There have been some who have received a 100% refund, though those are few and far between.

There are no guarantees that you would receive more so if they were to offer you 75% than I would be inclined to accept it.

I am not sure how the courts work in your country but in the UK if a reasonable offer is made pre-litigation and the claimant continues to court, then the judge could rule that they had acted unreasonably and so disallow the court costs.
