Hello Cardiffdude,

Why not email Comet this link:- http://tinyurl.com/32f4fp2 and ask them why the BIOS in your laptop was tweaked to switch the fans on 24/7 if it were not for potential overheating problems in your laptop?

Furthermore, they are wrong when they said:-

Quote:
You have stated that the product was outside the 12 month manufacturers warranty when you took it to your local store and then contacted HP and you have not contacted us back since early 2009 regarding this issue. You do have a duty of care to bring this to our attention again within a reasonable period of time, and 17 months later would not be classed as a reasonable period of time.

The thing is, you didn't appreciate in 2009 that your laptop was inherently defective and was doomed to fail prematurely. With this in mind, and considering the fact that you had already been fobbed off, you decided to not pursue the matter.

However, the minute that you discovered that your laptop was inherently defective you immediately re-contacted them.

Under the circumstances I would say that the date of failure should be recorded as the date you initially contacted them, which they have admitted to.

What do you think?

Best wishes

Paul
