Hi everyone

My laptop was purchased through the dell outlet store online on the 22nd of Aprill 2009.

On the 5th of October my laptop displayed the symptoms of the nvidia GPU defect so I had it checked out by a laptop repairs company who coincidently happen to specialise in this case. They have just called me to let me know that it is indeed the defect. I have two ways to pursue this either go it alone or go through a law firm that is partnered with the repairs company and has dealt with this many times before and has so far a 100% success rate.

Does anyone have any opinions on what would be better? The cost for the law firm I believe is a flat £100 (wouldn't be able to check until Monday) for this issue as they link with the repair firm, is this claimable from Dell if the case succeeds?

Also one thing that was mentioned to me was that if I do go it alone not to add anything to the letters that are given as templates on this forum as it can jeopardise the case. If I was to send them the starter letter to the head office is it best to just leave it as it is or could I add in the fact I have been offered a repair but they couldn't guarantee that it would be from a new batch and 100% free of defects?

Finally does the fact I purchased a refurbished model from the dell outlet make any difference to the overall proceedings.

Sorry for all the questions and thank you in advance for any help .

Hello and welcome to our forum.

Sorry to hear that your laptop has failed.

To be really honest with you there is no need to use a law firm in order to reach a positive resolution.

You would be better advised to simply obtain an engineers report and then pursue the retailer yourself.

I have extensive knowledge and expertise in this area and have been helping members of this forum reach a positive resolution for a number of years now.

Take a look through the forum and read how other members have been successful.

There is a step by step guide on this forum that will help you reach a positive resolution and that is here:-

If you follow my advise in that guide then you will be successful.

You mentioned that you have already had your laptop inspected. Have you already obtained the report?

If so then there is no need to send them that fist letter as you have already passed that stage.

If not then you should send the letter though I would advise that you mention the fact that you have already been offered a repair but they have been unable to guarantee that the part used will not be free from the defect.

I would also put in that letter that if they are prepared to offer such a guarantee then you would be willing to accept a repair.

No, that does not make any difference at all. The goods still have to comply with the Sale Of Goods Act.

I hope the above helps.

Any questions please let me know.

Best wishes

Paul

Hi Paul

Thank you very much for your reply. I read through the steps a few days ago and already drafted up a letter. I have not obtained an official written report yet it was a free diagnosis for students that I thought I should take advantage of just to check it was the issue I expected.

I will send the 'Letter before action' on Monday.

Thanks again.

Jake
