Hi there,

thanks for the speedy response.
I bought the laptop from a guy whose details
I got from university. He has a connection who supplies laptops
at very good prices.
I paid for the laptop in cash and I live in South Africa.
I feel totally desperate and frustrated as HP refuse to even consider
my claim as the one year warranty ended only a few months ago.
They are quoting me almost 2/3rds of the value of the laptop to replace
the motherboard.
WHAT CAN I DOO???????

Your case is a tricky one for the following reasons.

Was this a new retail sale or a used private sale?

Does HP recognise you as being the the owner of the laptop?

Have you got a purchase receipt?

Unfortunately I know nothing about the law in South Africa and I
don't suspect there will be such a thing as a Sale Of Goods Act
that you can call on to help.

The only thing you can do is to keep on pestering HP.

Phone them every day - email them every day.

Persistence is the key in matters like this and it really does pay
to be persistent.A thorn in their side so to speak.

I am sorry I cannot offer much help, but we can offer you
moral support.

Please keep us updated on how you get on with HP.

Hi,

Another update.

After a month, HP have still not responded to my request for a guarantee that the repair they offered, will be free from the NVIDIA defect.
HP (via their outsourced solicitor) have now filed a defence.

A summary of their defence is as follows:

1) I need to show proof that my laptop is defective.
2) My laptop was not defective when I bought it in 2007.
3) My laptop was manufactured to a satisfactory quality.
4) HP believes that it is not unreasoanble for a laptop to need a repair after two years.

A weak defence if you ask me especially as I have an Independent Engineers Report (of which I sent them a copy a while back)!

I think point 4 shows that even HP has no confidence in the reliability of their own laptops!

The next step will be sending my evidence to HP and the courts.

Hello Nedders,

The first thing that you have to bear in mind is that HP is currently the subject of various class actions in the US.

As a result of this HP will have to very careful about what they say or admit to in the the public domain.

It wouldn't do their case much good if they started to admit to problems with laptops not currently on their limited service enhancement list.

To answer their defence:-

You can show proof you laptop is defective by way of the engineers report.

It most certainly was. Your laptop contains a defective 8400 processor which is recognised and acknowledged by Nvidia as being defective.

Besides, the results of our tests prove conclusively that the GPU in your laptop is defective.

Quote:
3) My laptop was manufactured to a satisfactory quality.



No it was not - it was manufactured with a part that later turned out to be defective.

A product cannot be of satisfactory quality if one of the major components that it contains is inherently defective.

Quote:
4) HP believes that it is not unreasonable for a laptop to need a repair after two years.



Well, the results of a recent survey by Square Trade shows that HP's failure rate is 25.6% within the first 3 years.

So HP's comment that it is not unreasonable for a laptop to need a repair after 2 years is probably based on their experience of their own products.

However, the GPU is a major component that is soldered to the mainboard and so cannot easily be removed and replaced.

So this is not really a repair in the truest sense of the word.

Are HP saying that it is not unreasonable for a laptop to totally fail after 2 years?

Because that is what has happened.

You should be able to fire them down in flames based on that statement alone.

Like you said, HP have no faith in their products.
