Hi There,

I recently filed a claim against Sony.

The Claim Issue Date is 02/06/2011 and I haven't heard anything back from them and nothing has been updated on the Moneyclaim website.

I was wondering when I could Request Judgement?

Hello Rich and welcome to our forum.

Sony have 14 days from the date of service in which to acknowledge the claim.

That time limit has now passed and you should be able to apply for judgement by default.

Why not give MCOL a call tomorrow and see if they will let you file for judgement.

I tried to Request a Judgement but the Moneyclaim website is now showing:

"Sony UK issued an acknowledgment of service on 22/06/2011".

Yikes :shock:

Well according to their defence Richard, it seems like they think you're going after the wrong people. Apparently the retailer in this case is an independent retailer owned by Shasonic Ltd but just sold in a store that is called 'The Bromley Sony Centre'. Understandably (but possibly wrongly) you've filed the claim against Sony Europe Ltd who didn't actually sell you the laptop.

To me, the first thing to do would be to find out who exactly sold you your laptop, Shasonic or Sony. This should be on your receipt? Company number or something? Unfortunately the Sales of Goods Act can only be enforced upon the company/retailer that sold the product to you, rather than Sony who appear to be the distributer/manufacturer in this case.

Paul will know what to do much better than me I'm guessing - so don't take my word for it.

Figured they were part of Sony and I didn't get a reply to any of the letters I sent them so went direct to Sony.

I would've thought the same. Do you still have your receipt? -it should show the company address and VAT number of the retailer that sold it to you.

It has some contact details such as email, phone no. Interestingly the email does have a shasonic reference to it. I would phone/email them asking them what their company details are etc and perhaps what they were when you bought your laptop.

If it does turn out to be shasonic ltd that sold it to you, then I think Sony have been quite generous in offering to repair your laptop. Either you accept that and settle for that or go after shasonic for an similar/alternative settlement.

Hello Richdeniro,

It is unfortunate that you have filed the action in Sony's name instead if Shasonic's.

If you were to pursue the claim as it stands then you would probably lose as Sony have no contract with you.

I would advise that you contact MCOL and tell them that you have filed the action in the wrong name and that you wish to change the defendant to Shasonic Limited.

They may allow you to change the defendants name though there may be a charge for this but at least it will get your claim back on track.

Thanks so much for the advice guys.

I have lost the receipt but I have contacted Black Horse Finance for all my purchase details as I brought the Laptop on finance so they should have all the details.

I have also contacted Moneyclaim to see what steps I should take to drop the current action against Sony and start proceedings against Shasonic.

I will keep you updated on how things go.
