Having read those letters I can say that what was recommended was not necessarily correct.

Under the Sale Of Goods Act there becomes what is known as the reverse burden of proof. This means that it is up to you, the customer, to prove to Shasonic that your laptop is inherently defective. Shasonic cannot stipulate on which engineer performs inspection and evaluation.

Your non-response to their second letter was probably due to the misleading information that it contained.

If it was not misleading then it certainly did not inform you of your legal rights with regard to the obtaining of an engineers report.

Hello Rich,

That is a pretty standard response apart from the place of hearing.

The hearing should be in your town and not the defendants. Since you have brought the claim against Shasonic then they have to travel to your town on the day of the hearing.

Apart from that there is nothing to worry about in that document.

You should print off any emails or communications that you have had with Shasonic where you asked for a written guarantee that the repair would be free from the defect as this will enhance your reasons for refusing the repair.

Hi Paul,

Just a quick update - I received a letter from the court through the post titled 'Notice of Hearing'.

It just says that the Hearing will take place on November 29th at 2pm at Croydon County Court and that 30 minutes has been allowed for the hearing.

Despite ticking the mediation part on the allocation questionnaire I didn't receive anything back about that.

Is this the final hearing where the judge will make a judgement? Should I take anything with me?

As a matter of interest, when Shasonic offered you the free repair did you ask for the written guarantee?

Did Shasonic contact you after you submitted the engineers report and if so did you request the written guarantee that the mainboard to be used will be free from the defect?

I note that you purchase the laptop in finance. Did you ever pursue a Section 75 refund from the finance company?

Hi Paul,

Shasonic contacted me after submitting the engineers report but seemed to ignore it. The didn't offer a free repair unless the fault had been diagnosed by VAIOLINK. I already had the engineers report from Lapcure but they wanted it diagnosed by VAIOLINK before offering any resolution.

I have not pursued the Section 75 refund.

I have been unable to view this thread until now and so did not see I should send the engineers report to the court. If I send it by email now do you think that would sufficient or will it be ok if I take it to the court with me on Tuesday.

Must admit I am a little nervous about going to court.

Hello Rich,

Have you submitted any documents to court to support your claim?

You really should have sent to the court a copy of the engineers report plus any other supporting documents that you would wish to rely on.

I am a little worried that this may affect your claim and would advise you that you contact the courts tomorrow to see if you can send in a copy of the engineers report etc. They may refuse to allow this as there is a deadline for submitting documents.

If that is the case then the Judge may allow you to present the report on the day or you could request an adjournment to allow you to present your documents.

Give the courts a call tomorrow and see what they say then please let me know.

Fingers crossed that they accept the report etc. :x
